Apologies Flavio, I'm really sorry. I thought that I had already closed the question out, WITH THANKS TO EVERYONE FOR THEIR HELP, and having it still open was just some glitch.
Clarification was sought from the client, with no response. The final translation was a combination of the suggestions given, but the "right" translation remains unclear.
So, again, sorry about the mix-up, and THANKS to Ricardo, eski, Dave, Flavio and Alicia!!!

At any rate, that part would be "this point of the charges" instead of only "the charges", wouldn't it? My main doubt lies in the translation of TOMARSE EN CUENTA. Is that different from "tenerse en cuenta", especially in a legal document?

There's a significant difference between your question "los cargos no deberían tomarse en cuenta" and your last quote "...este punto de los cargos no debería tomarse en cuenta". Which one is correct?

Sanction for having improper slogans on a product The company said something like "This product increases your health" and the Consumer Agency said that was improper, on the basis of several regulations. The company says it made the changes on the product label, so they shouldn't be sanctioned for the improper phrases now.

I think you're first hunch is more likely to be correct. I many instances, a charge which has been made (prior) is not allowed because it is not germain to the proceedings:
It must not take into consideration a charge which has been committed or sent ... should not be invited to have an offence taken into consideration in the ...

Now taking into account the context you provide, I'd say it refers to a legal claim therefore "dismissed" is the right legal terminology here, meaning those accusations should not be taken into account.

In this context the term "cargos" could be either counts (count one, count two, etc.); or the accusation as a whole.
It isn't clear if "este punto" refers to an individual count in a complaint or something else, so it is safer to call it an "item".
Tomarse en cuenta = to be taken into/under consideration
Tenerse en cuenta = to keep in mind/to have in mind
