□ 원고적격 확대(대상지역 밖의 주민 원고적격 인정)
○ 환경영향평가 대상이 되는 사업의 입지를 결정한 행정처분에 대한 소송사례가 있다. 기존 대법원 판례는 환경영향평가 대상지역에 살고 있는 주민의 원고적격만 인정하였다. 그러나 해당 판례는 대상지역 밖의 주민이라고 하더라도 환경상 이익 침해우려를 입증함으로써 원고적격을 인정받을 수 있다고 결정하였다.(대법원 2006두330)

□ 입지선정 참여권 인정 판례
○ 폐기물처리시설 입지시 거쳐야 하는 참여절차를 적절히 거치지 않은 경우 해당 입지결정처분이 위법하여 무효라고 한 사례가 있다. “폐기물처리시설 설치촉진 및 주변지역 지원 등에 관한 법률”은 입지선정위원회의 구성방법 및 절차 등에 관한 규정하고 있다. 해당 사건에서는 주민대표가 추천한 전문가를 포함시키지 않은 채 위원회가 구성되어 입지와 관련된 의결을 하였다. 법원은 이는 중대하고 명백한 하자로서 그에 기초하여 이루어진 폐기물처리시설 입지결정처분은 무효사유에 해당한다고 판시하였다.(대법원 2006두20150)

• Expansion of standing to sue (Residents living outside of an area concerned are admitted to have standing to sue)
○ There was a case where a lawsuit was filed against an administrative disposition that decided the location of a project subject to environmental impact assessment. An existing judicial precedent by the Supreme Court admitted that only residents living inside an area subject to environmental impact assessment had standing to sue. However, the judgment in the case ruled that even residents outside of an area concerned can be admitted to have standing to sue if they prove probable damages to their environmental interests. (The Supreme Court 2006DU330)

• Case: Recognition of right to participate in location selection
○ There was a case where it was ruled that if a disposition to decide the location of a waste treatment facility did not go through the required residents’ participation process, it was unlawful and void. The “Promotion of Installation of Waste Disposal Facilities and Assistance, etc. to Adjacent Areas Act” provides for the composition of a Location Selection Committee, its process, etc. In the case concerned, the committee was composed excluding an expert recommended by the representative of residents and made a decision concerning the location. The court ruled that this was a serious and obvious legal flaw, and so the disposition to decide the location of a waste treatment facility fell under the cause of invalidation. SEC. 2. FINDINGS.
Congress finds the following:
(1) Women have entered the workforce in record numbers over the past 50 years.
(2) Despite the enactment of the Equal Pay Act in 1963, many women continue to earn significantly lower pay than men for equal work. These pay disparities exist in both the private and governmental sectors. In many instances, the pay disparities can only be due to continued intentional discrimination or the lingering effects of past discrimination.

SEC. 8. COLLECTION OF PAY INFORMATION BY THE EQUAL EMPLOYMENT OPPORTUNITY COMMISSION.
Section 709 of the Civil Rights Act of 1964 (42 U.S.C. 2000e–8) is amended by adding at the end the following:
‘‘(f)(1) Not later than 18 months after the date of enactment of this subsection, the Commission shall issue regulations to provide for the collection from employers of compensation data and other employment-related data (including hiring, termination, and promotion data) disaggregated by the sex, race, and national origin of employees.
‘‘(2) In carrying out paragraph (1), the Commission shall have as its primary consideration the most effective and efficient means for enhancing the enforcement of Federal laws prohibiting pay discrimination. For this purpose, the Commission shall consider factors including the imposition of burdens on employers, the frequency of required reports (including which employers should be required to prepare reports), appropriate protections for maintaining data confidentiality, and the most effective format for reports containing such data.’’.

의회는 다음 사실을 인정한다.
(1) 여성은 지난 50년 동안 기록적인 숫자로 노동 인력에 편입되었다.
(2) 1963년 「동일임금법」 제정에도 불구하고, 여전히 많은 여성이 동일한 일에 대해 남성보다 현저히 낮은 임금을 받고 있다. 그러한 임금 격차는 민간 부문과 정부 부문 양쪽 모두에 존재한다. 많은 경우, 임금 격차는 계속되는 의도적 차별이나 과거 차별의 지속적 영향 때문이다.
