Catalan term or phrase: de forma contradictoria
Fora del cas a que es refereix el paragraf anterior, l'import de la modificacio es fixara de forma contradictoria entre les parts, prenent com a base els preus establerts en el projecte..

I understand what it means, I think: both parties are going to calculate what they estimate the cost of the modification to be. Ultimately, where there are discrepancies, the contracting body's total will be used in the first instance, and where this body's total is not the same as the contractor's total, claims can be filed and the matter will be decided at court.

But I don't know what the name for that process would be, in specific reference to 'de forma contradictoria', in English.

Any ideas?

If you need a term to imply there is a conflict between the two sides then this one would do, but I'd be tempted to simply say "after discussions with both sides".
