6.1. As to spare parts (“make to stock”), Customer may, upon giving Supplier at least 10 (ten) calendar days’ notice prior to the agreed date of delivery, postpone such date for all or part of the Products ordered, or terminate the Contract in whole or in part. If and to the extent any costs incur to Supplier due to such postponement, the parties shall agree on any unavoidable costs. If the Customer terminates the Contract, then the Supplier is entitled to demand the agreed remuneration; however, it must allow set-off of the expenses it saves as a result of cancelling the Contract or acquires or willfully fails to acquire from other use of its labor. There is a presumption that the Supplier is accordingly entitled to five percent of the remuneration accounted for by the part of the work not yet provided.

Explanation:
Если договор (был) расторгнут Заказчиком, Поставщик имеет право потребовать вознаграждение (определенное по договору); тем не менее, он должен учитывать соразмерную часть расходов, которых он избежал/сэкономил в результате расторжения Контракта или благодаря использованию или умышленному неиспользованию своих рабочих сил в других целях. Предполагается, что Поставщик, соответственно, имеет право на получение вознаграждения в размере пяти процентов, соответствующей части еще не выполненных работ.
