This is from a power of attorney to purchase a property:

Dans un délai de dix jours à compter du lendemain de la première présentation de la lettre de notification, le CONSTITUANT pourra exercer la faculté de rétractation, et ce par lettre recommandée avec accusé de réception ou exploit d'huissier, à son choix exclusif.
This is a requirement for the buyer to be sent the pre-sales contract by registered post, so as to trigger a 10-day right of retraction period - standard stuff in France - even though, presumably he has already seen and signed it.

"First presentation of the letter of notification" sounds muuch too literal to me.

What does anyone think of "first attempt to deliver the letter of notification"? (e.g. the postman knocks on the dooe but nobody is in)

What happens in practice is that after the first attempted delivery, La Poste will leave a note for you saying that it missed you/you were out, would you like it to attempt to deliver again the following day.
The following day, if the attempt to deliver fails again, you get a second note saying that you can collect your letter (or indeed parcel) from the local post office.

Fascinating details, I'm sure you'll agree.

Explanation:
I'm unsure it is an attempt as it could still be valid service even if not 'remise' or distributed to the addressee.

The dismissal : licenciement notice procedure seems to make this quite clear. The letter might be left in a letter box, with a neighbour or posted up on a notice board and in Anglo-terms 'brought to the adddressee's attention' or US Am. parlance brought within the latter's 'purview'.

'Every tender of an Exercise Notice in accordance with Section B-301(a) shall be irrevocable except that where an Exercise Notice is tendered in error, it may be cancelled by the Clearing Member until the Close of Business on the Business Day when the erroneous tender was made.'

Obiter, I am not in France at the mo, but have had to translate many of such huissier postal or personal service forms or 'Affidavits'.

Asker: Thanks Adrian, my understanding is that the postman's "attempt to deliver" (if nobody is at home) will be accompanied by pushing a "avis de passage" through the letterbox. Emmanuella's excellent reference explains it.
