Art market case. Mr BBB is saying that Mr AAA, who is the administrator of a dead artist's estate, unjustifiably refused to accept that a dodgy painting (bought by Mr BBB) is by the dead artist.

At this point there is a stimulating discussion about Mr BBB's interest in bringing proceedings, right to bring proceedings and capacity to bring proceedings.

The "legal attributions of the right to bring proceedings" is, of course, an expression that trips off my tongue: I must use it tens of times each week. But what do I mean by it? Seriously, does this mean something like the conditions which must be met to qualify?

EN: "The right of action is available to all those who have a legitimate interest in the success or dismissal of a claim, without prejudice to those cases where ***the law confers the right of action*** solely upon persons whom it authorises to raise or oppose a claim, or to defend a particular interest."

FR: "L'action est ouverte à tous ceux qui ont un intérêt légitime au succès ou au rejet d'une prétention, sous réserve des cas dans lesquels ***la loi attribue le droit d'agir*** aux seules personnes qu'elle qualifie pour élever ou combattre une prétention, ou pour défendre un intérêt déterminé."


Although the quality of the English translations that were published on Legifrance varied, I think this is a good one.

To Mpoma: ah, in fairness to you sometimes the Legifrance translations are good, sometimes mediocre, not necessarily the mandatory first port of call! I had a look in Bridge first.
