Asker: Thanks... but: what philgoddard said. That "La Voix" link illustrates the problem: that's actually quite a poor translation from the FR to the EN: e.g. "a previous judgment, which allege...". Not only is the verbal form wrong, but judgments don't allege.

Just before you go kidnapping anyone (interesting solution!), I would point out that slightly different versions of the phrase involving "registration" and "application" rather than "trademark" appear at least twice on www.legislation.gov.uk, which is a pretty authoritative website as far as legal references go:

"In the application of sections 21 and 21B in relation to an international trade mark (EC), references to a registered trade mark are to be treated as references to an international trade mark (EC) in respect of which particulars of an ***international registration designating the European Union*** have been published...

I must admit, though, I share your puzzlement over the low search result numbers. I got surprisingly poor results for "designation" in particular when I combined it with several other relevant search words, which I can't understand as WIPO uses it. One thing I observe is that "registration" seems to be used quite a bit instead of "trademark" in relevant online literature, but I get the feeling there may be more to it than just that difference.
