Si el causante es el actor que cometió algún acto doloso, a éste se le refiere como tortfeasor. Pero si se trata de un caso de insania, entonces a éste no se reconoce legalmente como competente para actuar y en ese caso quizás sería más apropiado usar "plaintiff" ya que se trata de la persona que insta el caso ante el tribunal.
