1. Objeto:
El objeto de esta especificación técnica es el de fijar las condiciones de cálculo a aplicar en las cajas y soportes a instalar en las UTE-Si Rehabilitadas.
Esta especificación se basa en la Especificación de Compra: 05.U0.99.12.005, a la que anula y sustituye desde el punto de vista de condiciones de cálculo, ya que la amplia y puede ser aplicada a otros equipos que no comprende la anterior Especifi-cación.
En las UTE-Si Rehabilitadas se aprovechan exclusivamente las cajas de las antiguas UTE-Si, en ellas se incorporan tanto el interiorismo como todos los equipos totalmente nuevos. Estos equipos son: aire acondicionado en techo, nuevos equipos de tracción, neumáticos, baterías, etc. bajo bastidor. Todo esto hace que sea necesario realizar un nuevo calculo de la estructura y de los soportes de los equipos correspondientes para determinar el buen comportamiento de las UTE-Si después de la rehabilitación.
2. Normas a aplicar:
Se aplicara la norma europea EN-12663 y como complemento en caso de falta de da-tos la UIC-566 –OR.
3. Sistema de coordenadas:
Eje X: Eje longitudinal del vehículo, es la dirección del movimiento.
Eje Y: Eje transversal del vehículo, esta en el plano horizontal.
Eje Z: Eje vertical, el sentido positivo apunta hacia arriba.
4. Casos de carga a aplicar:
4.1. Cargas simples independientes.
4.2. Combinación de cargas
4.3. Cargas de fatiga
5. Tipos de cálculos a realizar:
Tanto para las cajas como para los soportes se realizaran tres tipos de cálculos:
5.1. Cálculos Estáticos: Basándose en los casos de carga 4.1 y 4.2, con las cargas estáticas que se definirán mas adelante, se determinaran las tensiones máxi-mas en cada tipo de estructura.
Estas tensiones máximas serán iguales o inferiores a las tensiones admisibles definidas en el punto 6.
Para el caso particular del cálculo de las cajas, se determinarán las flechas máximas de la estructura con las cargas anteriormente citadas.
5.2. Cálculos a Fatiga: En principio se utilizara el Método de Resistencia Límite, de forma que todas las tensiones (ver zonas de concentración de tensiones) que se calculen en las estructuras estén por debajo de la Tensión Limite de Fatiga, a partir de la cual se producen daños por fatiga.
En caso de necesidad se utilizará el Método de Daño Acumulado, con el que las tensiones calculadas tendrán que ser inferiores a las marcadas en los diagramas S-N del material correspondiente para 107 ciclos, evaluando el daño total según la hipótesis de acumulación de daños establecida (como la de Palmgren-Miner).
5.3. Modos de vibración:
5.3.1. Para las cajas, se determinarán los modos propios de vibración total-mente equipadas, comprobándose que se encuentran muy separados y son independientes de las frecuencias propias de vibración de las suspensiones.
5.3.2. Para los soportes de los equipos, se determinarán los modos propios de vibración con sus equipos correspondientes, comprobándose que se encuentran muy separados y son independientes de las frecuencias propias de vibración de las cajas y de las suspensiones.
6. Tensiones admisibles:
Las tensiones calculadas en cualquier caso de carga deberán ser inferiores a las ten-siones admisibles para el caso de carga correspondiente.

Calculation specification:
Bodies and body-mounted equipment
1. Objective:
The objective of this technical specification is to set the calculation conditions to be applied for the bodies and mountings of UTE-Si Rehabilitada (‘Refurbished UTE-Si’) train vehicles.
This specification is based on Purchase Specification 05.U0.99.12.005. It supersedes and replaces the latter specification in terms of calculation conditions because it ex-tends these conditions and it can be applied to other equipment not covered by the previous specification.
Only the old UTE-Si bodies are used in UTE-Si Rehabilitada trains, which are fitted out with new interiors and equipment. This equipment includes roof-mounted air conditioning and new traction equipment, tyres, batteries, etc. under the chassis. This means that equipment structures and mountings must be recalculated in order to ensure good performance of UTE-Si trains after refurbishment.
2. Applicable standards:
The European standard EN-12663, supplemented by the UIC-566 –OR standard when more information is required.
3. System of coordinates:
X axis: Longitudinal axis of the vehicle: the direction of movement
Y axis: Transverse axis of the vehicle: in the horizontal plane.
Z axis: Vertical axis: positive direction, pointing upwards.
Three types of calculations are done both for the bodies and the mountings:
5.1. Static calculations: The ultimate tensile strengths in each type of structure are established on the basis of the load cases 4.1 and 4.2 and static loads which will be defined below. These ultimate tensile strengths must be less than or equal to the permissible stresses defined in point 6.
In the specific case of calculations for bodies the maximum deflections of the structure will be established on the basis of the aforementioned loads.
5.2. Fatigue calculations: In principle, the endurance limit approach is used, so that all stresses (see stress concentration zones) that are calculated in the structures are below the fatigue limit, beyond which damage as a result of fatigue begins to occur.
When necessary, the cumulative damage method is used. In this method the calculated stresses must be lower than those indicated on the S-N Curve for the corresponding material over 107 cycles, with the total damage being evaluated according to the established cumulative damage hypothesis (such as the Palmgren-Miner linear damage hypothesis).
5.3. Modes of vibration:
5.3.1. For the bodies the intrinsic vibration modes for completely equipped vehicle bodies must be established. It is essential to ensure that they are very well separated and that they are independent of the intrinsic vibration frequencies of the suspensions.
6. Allowable Stress:
The stress calculated for any load case must be lower than the allowable stress for this load case.

Reglas de origen y sus principales efectos: una revisión formal del argumento estándar
Introducción
El presente artículo examina las limitaciones metodológicas de la
hipótesis sobre el efecto proteccionista de las reglas de origen
preferenciales (RO). Con ese fin substancia la capacidad explicativa de dos variables desatendidas por el modelo estándar: a) el salario y su potencial predominio en la explicación del reem-plazo de proveedores de productos intensivos en mano de obra; y b) el costo adminis-trativo provocado por la superposición de regímenes de origen. En la primera sección se reseñan las principales aportaciones teóricas; en la segunda y tercera se formalizan las extensiones del modelo tradicional y enseguida se delimitan sus consecuencias teóricas. Las conclusiones asientan la necesidad de considerar los efectos de las RO desde posiciones teóricas distintas al proteccionismo comercial.
Marco conceptual
Las RO se definen como el conjunto de disposiciones y métodos que especifican la procedencia de las mercancías de los países miembro de una zona de libre comercio (ZLC). Tienen por función impedir la triangulación comercial, y aunque no siempre logran ese cometido, su posición central en la administración de las preferencias les confiere un papel estratégico. El hecho se explica en gran medida por las normas y aplicaciones de origen que asocian a tres aspectos esenciales del proceso de integra-ción: a) el eslabonamiento internacional en la fabricación de una mercancía; b) la procedencia nacional y el grado de elaboración de los insumos contenidos en el producto final; y c) de manera más amplia, las condiciones de creación y desviación de comercio.
En su primera etapa, la reflexión especializada se ocupa de las diferencias entre las RO y el arancel externo común de las uniones aduaneras (UA). Como se sabe, la triangulación se controla en las UA mediante la unificación de la política comercial de los países miembro. De acuerdo con Shibata (1971), las diferencias entre uno y otro esquemas permiten que las ZLC generen un tipo de desviación que las RO no pueden controlar. Ello se debe a que el proceso de regionalización suele ser más acentuado en el país con los aranceles externos superiores. Por su parte, el estudio de Mussa (1984) demuestra que el incremento de los costos de las importaciones provocado por el régimen de origen puede no ser tan elevado como el que procuran los aranceles; dicho en otros términos, la sustitución del proveedor no necesariamente implica un aumento en el precio de los productos. Más tarde Krueger (1993) retoma la compara-ción con el arancel externo común para señalar que los elevados requisitos de origen hacen que la ZLC sea un esquema potencialmente más proteccionista que la UA.
Resultado de la proliferación de los acuerdos comerciales y la mayor autono-mía teórica de las ZLC, los estudios más recientes centran su interés en los efectos proteccionistas de las RO. Para Grossman (1981), Krueger (1993), Falvey y Reed (2000) y Lloyd (2001), entre otros, la protección del contenido regional estimula: a) la sustitución no competitiva de insumos; b) el encarecimiento del producto final; c) la creación de una suerte de cuota de insumos con tendencias monopólicas; y d) su aprovechamiento para asegurar la adquisición de determinados bienes intermedios. Asimismo, Krishna y Krueger (1995) afirman que las RO pueden privilegiar los enca-denamientos industriales de la zona en detrimento de la competitividad.
Ju y Krishna (1998) distinguen las RO de los insumos y de aquellas que se aplican a los productos finales, y concluyen que ese régimen estimula a un tiempo la creación de comercio de productos finales y la desviación de insumos. La simulación de una ZLC exenta de reglas de origen autoriza a Ju y Krishna (1996) una conclusión categórica: la ausencia de RO estimula la creación de comercio. Desde posiciones similares, Augier, Gasiorek y Lai-Tong (2003) comparan dos ZLC, una provista de RO tradicio-nales y otra dotada de reglas de acumulación entre países; su principal resultado es que el primer acuerdo reduce en poco más de 50% el intercambio comercial espe-rado. Estevadeordal (2000) comprueba que el régimen de origen del Tratado de Libre Comercio de América del Norte (TLCAN) responde a los mismos factores de política económica que los aranceles. Finalmente, Suominen (2003; 2004) llega a conclusiones equivalentes respecto de la Unión Europea.
Para validar el argumento proteccionista, la mayoría de los autores consideran el diferencial de precios de los insumos regionales e internacionales. El núcleo del argumento puede resumirse en un enunciado: si las RO protegen los productos inter-medios menos eficientes de la zona, entonces la sustitución de insumos debe ser an-ticompetitiva y perjudicial para el bienestar. En consecuencia, la toma de decisiones buscará reducir o incluso eliminar los requisitos de origen. La lógica de este argu-mento, empero, es influida por algunas simplificaciones que socavan su sensibilidad frente a los casos reales. Entre las insuficiencias está la exclusión de: a) la inversión, variable dinámica que puede determinar los efectos anticompetitivos y hacer que sean compensados por la creación de inversión4; b) el salario, relevante en las ZLC con amplias disparidades en el ingreso; y c) los costes administrativos, onerosos sobre todo en los llamados spaghetti bowls (entrecruzamiento de acuerdos)5. Las secciones siguientes examinan la importancia de estas variables y buscan definir las consecuen-cias teóricas de la extensión del argumento estándar.
Argumento estándar
Para los propósitos de este trabajo es necesario ante todo formalizar el argumento estándar sobre los efectos proteccionistas de las RO. Según el modelo básico6, A es el fabricante de un producto final (Pf) y B el fabricante de uno de sus insumos (I2), ambos localizados en dos países distintos de una zona de libre comercio. Se supone que el proceso productivo incluye los insumos I1, I2 y I3, donde el valor de I2 es igual a una quinta parte del coste neto (Cn) del producto final (obsérvese que la mano de obra T y el capital C son constantes):

Si el precio de I2 es superior al valor de un sustituto perfecto producido fuera de la zona (I*), A preferirá la importación de este último para abaratar sus costos (I* < 1/5 Cn). Sin embargo, en presencia de RO, la exención de aranceles u otras restricciones a las exportaciones de B puede abaratar el insumo I2 por debajo de la diferencia con I* si el nivel arancelario no preferencial (arancel NMF) más el precio de I* es superior a 1/5 Cn:

Según este modelo, las RO constituyen una normativa básicamente anticompeti-tiva. Aun si I2 tiene un valor igual o inferior a I*, las RO pueden considerarse protec-cionistas.
Salario como variable explicativa
Para activar el salario como variable explicativa, tomemos en cuenta la industria de textiles y vestimenta del TLCAN, rama cuyas reglas de origen son consideradas por diversos analistas como particularmente anticompetitivas7. Según la gráfica 1, las importaciones mexicanas de algodón registran un aumento constante entre 1994 y 1998, mientras que las adquisiciones estadounidenses del mismo producto sufren una pronunciada desaceleración y, salvo por el periodo 1995-1996, se mantienen en niveles relativamente bajos. La gráfica 2 muestra el simultáneo aumento de las importaciones estadounidenses de un tipo de prenda confeccionada en México con algodón importado (partida 84151); el cuadro 1 compara las curvas de las importa-ciones mexicanas de algodón sin hilar y de las exportaciones de la prenda de algodón a los Estados Unidos. El coeficiente de correlación para el periodo 1994-2007, 0.834, refleja el estrecho vínculo entre uno y otro flujos.
La información recabada sugiere que el TLCAN genera un proceso de sustitución de proveedores de algodón en dos sentidos: a) los productores mexicanos absorben gran parte de las importaciones de bienes intermedios (algodón) que antes adquirían las firmas de los Estados Unidos; b) el país del Norte aumenta las importaciones de productos finales mexicanos, presumiblemente sustituyendo a los proveedores exter-nos a los Estados Unidos.
¿Qué función desempeñan las RO preferenciales en este doble proceso? Una res-puesta exhaustiva excedería los propósitos del presente artículo; aquí interesa sobre todo que la sustitución de insumos y de productos finales se explica mayormente por el valor de la subcontratación y ésta, a su vez, por las disparidades salariales del TLCAN. Para captar ese fenómeno desagreguemos la variable laboral en la mayor (o inicial) remuneración por hora en la industria manufacturera (T1), y la menor (o final) remu-neración (T2), ambas en los Estados Unidos. Si activamos los valores T en la ecuación 2 tenemos dos casos extremos. En el primero, la diferencia de precios de los insu-mos regionales e internacionales es superior a la diferencia de salarios de un país miembro con respecto a otro de la misma zona (I* - I2 > T1 - T2). En el segundo, la diferencia de precios internos y externos es inferior a la diferencia de los salarios intragrupo (I* - I2 < T1 - T2).
Sólo en el primer caso (o primer tiempo), las RO pueden causar desviación de comercio y esto ocurre porque la norma agrava los costes de producción mediante la sustitución anticompetitiva de insumos. En el segundo caso, en cambio, la sustitución de proveedores está guiada por la búsqueda de mayor competitividad por medio del aprovechamiento de los menores salarios regionales. Si la diferencia de salarios es importante, la norma resulta secundaria para explicar la sustitución de proveedores y se subordina al conjunto de factores de la optimización.
Las particularidades del régimen norteamericano ilustran esta segunda afirma-ción. Las reglas estadounidenses ofrecen ventajas arancelarias a la maquila mexi-cana (gravada con poco más de 4%) muy superiores a la oferta asiática (56% de imposición) e incluso a la centroamericana (14% antes de la entrada en funciones del Tratado de Libre Comercio Centroamérica–República Dominicana, CAFTA–DR)8. Sin embargo, dado que el salario en la industria manufacturera de México es ocho veces inferior al estadounidense, esta variable se constituye como el principal vector de la sustitución de proveedores.
Complicaciones administrativas de las RO
La intricada técnica de las RO se inicia con sus tres métodos de cálculo. El cambio en la clasificación arancelaria (CCA), la regla más utilizada, confiere origen al producto que resulta de una sustancial transformación o “salto” a un capítulo (o partida) desde cualquier capítulo (o partida) distinto del Sistema Armonizado de Designación y Co-dificación de Mercancías (SA)9. Si la mercancía no cumple con ese requisito, la firma dispone de dos métodos adicionales. El valor de transacción (VT) o coste neto (CN) se utiliza principalmente en el caso de productos químicos, calzado y maquinaria. Para su cálculo se emplea la fórmula:
VCR = VT – VMN / VT • 100
donde VCR representa el valor del contenido regional y VMN el valor de los materiales no originarios (el CN emplea la misma fórmula ajustando el VCR al porcentaje establecido en el acuerdo)10. Si aun con el segundo método la mercancía no califica, la firma puede apelar a una tercera, denominada acumulación. Ésta confiere origen al producto cuyos insumos emplean materiales intermedios de fuera del área. Utilizada en menores casos, se obtiene mediante la desagregación del proceso productivo en partes identificables, con la finalidad de rescatar los insumos y costes intermedios del área11. La relación de estos métodos puede verse como un flujograma de opciones simples (figura 1).
Sin embargo, la elección de uno u otro métodos no es similar en todos los acuerdos. La ALADI prevé sólo el CCA. El TLCAN, cuyo régimen está plagado de reglas específicas, reconoce este método, pero también la determinación del país donde se fabrican los componentes extranjeros, el lugar del embalaje y de la última etapa de manufactura. En este acuerdo la elección se sujeta a una jerarquía de seis reglas (figura 2).
Mayores complicaciones plantea la superposición de varios acuerdos comerciales, sobre todo cuando varían las especificaciones de origen, los procedimientos aduaneros, los mecanismos de solución de controversias, las funciones de los comités especiales, la forma de administración de requisitos, o las oportunidades para flexibilizar la regla de un producto. Las complicaciones se amplían, si cabe, cuando existen numerosas canas-tas arancelarias. Estos casos no son raros; cuando una firma mexicana exporta filamento sintético (incluido en la fracción 54 011 001) a los países con los que no tiene acuerdos, su producto enfrenta un arancel NMF de 18%. Cuando se ampara en los acuerdos de libre comercio, los aranceles son: cero (al final del periodo de transición) en los casos del TLCAN, el TLC Costa Rica, el TLC Chile, el TLC Nicaragua, el TLC Unión Europea y el TLC Israel; 2.5% en el TLC Bolivia; 4.5% y 5.5% en el G-3 Colombia; y 12% según la preferencia arancelaria de la ALADI (G-3 Venezuela, por ejemplo).
Estimación de los costes administrativos
Estas complicaciones escapan sin duda al conocimiento promedio de las firmas, aun-que no por ello pueden desatenderse. Los gastos en los que puede incurrir la firma con el fin de administrar exitosamente las RO de su producto, incluyen13: a) la con-tratación de personal para los trámites de facturación y certificación; b) la adaptación de la producción a los requisitos de diferentes RO (con el consiguiente riesgo de sustitución anticompetitiva de insumos); c) la ocasional contratación de peritos en derecho aduanal (principalmente cuando las autoridades del país importador aducen subfacturación o piden información adicional bajo esta sospecha); d) la contratación de asesorías que diseñen las estrategias negociadoras de los nuevos acuerdos o para la revisión de los vigentes; e) la mayor vulnerabilidad ante errores administrativos o la información incompleta, poco fiable o dispersa; y f) el aumento de los tiempos de respuesta institucional a causa del número de acuerdos y sus especificidades.
¿Cuál es el costo administrativo de las RO desde el punto de vista del exportador? En Brasil, el organismo encargado de ese trámite cobra entre 6 y 20 dólares por car-gamento; en Chile, la tarifa asciende a 7 dólares (Estevadeordal y Suominen, 2005). En sus inicios, la tramitación de la documentación en la Asociación Europea de Libre Comercio oscilaba entre 3% y 5% del valor FOB de la mercancía (Herin, 1986); en Finlandia, por su parte, las firmas erogaban entre 1.4% y 5.7% del valor de las expor-taciones (Koskinen, 1983). En México, la certificación es gratuita, aunque algunos estudios sugieren que las exportaciones amparadas en el TLCAN o en otros acuerdos también generan costes no especificados (Cadot et al., 2002)14.
Con estas variaciones en mente consideremos una empresa mediana cuyo número de operarios y su cifra de negocios coincida con el promedio de los fabricantes mexi-canos de fibra sintética (500 trabajadores, US $10 millones de ventas). En términos generales, el salario de un trabajador administrativo equivale a US $10 por hora. Para la realización de las actividades asociadas a los diversos trámites de las RO se requieren 10 horas por cada cargamento de 1 000 piezas. Si el precio de cada pieza es US $10, el cargamento tendrá un valor de US $10 000 más costos de embalaje y transporte.
Si el cargamento se ampara en un solo acuerdo (o regla o destino preferencial), el costo administrativo equivale a 10 centavos de dólar por pieza; cuando el mismo cargamento se ampara en dos acuerdos distintos (500 piezas cada uno), el costo se incrementa en menos del doble debido a la parcial integración de las actividades ad-ministrativas; si exporta bajo dos o más acuerdos, el costo aumenta de acuerdo con un coeficiente (L), el cual designa el límite en la integración de las actividades o la irreductibilidad de algunas tareas.
El caso puede expresarse apelando a (L) y a las ecuaciones 3, 4 y 5. Estas igualda-des describen los costes de las RO según el número de mercados de exportación de la firma. El gasto administrativo (G) está en función de (x) o el incremento de los costes como consecuencia de la superposición de regímenes de origen15.

De acuerdo con la ecuación 5, la proliferación de las ZLC puede afectar el precio del producto dentro de una gradación de escenarios. En un extremo, el mercado exter-no tiene una preferencia suficientemente profunda como para asegurar la rentabilidad de la exportación y, en ese caso, la firma prosigue con la estrategia de exportación apelando a varias ZLC. En el otro extremo, la diversificación es encarecida por el co-eficiente (L) hasta el nivel en el que prefiere concentrarse en un solo mercado. Ambos escenarios dependen de la diferencia entre el arancel preferencial y el arancel NMF del país importador.
Obsérvese que no es necesario que el valor de (L) sea elevado; si éste se aproxima al arancel no preferencial del país de destino, el valor de (GL) reduce la ventaja del acuerdo y éste se convierte en irrelevante respecto de otros factores (tamaño del mer-cado, costes de transporte, competitividad del producto).
A partir de estas igualdades es posible extraer una consecuencia general. Los spaghetti bowls invalidan las previsiones teóricas sobre el comportamiento protec-cionista de las RO y ponen de relieve la dimensión administrativa del comercio pre-ferencial. La intención proteccionista, en caso de existir, es rebasada por las elevadas complicaciones del régimen y terminan por afectar a la empresa presuntamente pro-tegida. A diferencia de los aranceles, que en principio contribuyen al ingreso fiscal y buscan proteger la industria incipiente, la exacerbación del gasto administrativo se comporta como un derroche de recursos.
According to equation 5, the proliferation of FTAs can affect the price of a product in a range of scenarios. At one extreme, the depth of preference offered by the foreign market makes exportation profitable; in this case the firm proceeds with its export strategy, operating within various FTAs. At the other extreme, the coefficient (L) increases the cost of diversification to such an extent that the firm prefers to concentrate on one market. Both scenarios depend on the difference between the preferential tariffs and the MFN tariffs applied by the importing country.
It is worth noting that the value of (L) does not need to be high; if this value approaches the non-preferential tariff of the importing country, the value of (CL) reduces the benefits of the agreement and the agreement becomes irrelevant compared to other factors (market size, transport costs, product competitiveness).
From these equations we can draw a general conclusion. “Spaghetti bowls” invalidate theoretical predictions about the protectionist behaviour of ROO and highlight the administrative dimension of preferential trade. The protectionist intention, if it exists, is outweighed by the extensive complications of the regulatory framework, which eventually affect the supposedly protected business. Unlike tariffs, which in principle contribute to tax revenues and are geared towards infant industry protection, the increased administrative costs act as a drain on resources.

This article examines the methodological limitations of the hypothesis on the protectionist effect of preferential rules of origin (ROO). To this end it provides evidence for the explanatory capacity of two variables that are neglected by the standard model: a) wages and their potential power in explaining the substitution of suppliers of labour-intensive products; and b) the administrative cost of the overlapping of origin regimes. The first section reviews the main theoretical contributions to the subject, the second and third sections formalise extensions of the traditional model and the fourth section defines the theoretical
consequences of these extensions. The conclusions establish the need to consider the effects of ROO from theoretical positions which are distinct from that of trade protectionism.
Conceptual Framework
ROO are defined as the combination of provisions and procedures which specify the origin of goods in the member countries of a Free Trade Area (FTA). Their function is to impede triangular trade and, while they don’t always achieve this task, their central role in the management of preferences affords them a strategic role. This is largely explained by rules of origin and applications of rules of origin which connect three essential aspects of the process of integration: a) international linkages in the manufacture of goods; b) the country of origin and the level of processing of the input materials which form part of the final product; and c) more broadly, the conditions for trade creation and diversion.
At first, specialised study in the field addressed the differences between ROO and common external tariffs in customs unions (CUs). As is well known, in CUs triangular trade is controlled by the unification of member countries’ trade policies. According to Shibata (1971), the points of difference between FTAs and CUs are what allow FTAs to produce a type of trade diversion which ROO cannot control. This is because the regionalization process is usually more prominent in the country with higher external tariffs. A study carried out by Mussa (1984) demonstrated that increases in the costs of imports as a result of origin regimes may be lower than those caused by tariffs; in other words, the substitution of producers doesn’t necessarily imply an increase in the price of products. Later, Krueger (1993) took up this comparison with common external tariffs, highlighting the fact that, where high origin requirements exist, FTAs are potentially more protectionist than CUs.
As a result of the proliferation of trade agreements and the greater theoretical autonomy of FTAs, more recent studies have focused on the protectionist effects of ROO. According to authors such as Grossman (1981), Krueger (1993), Falvey and Reed (2000) and Lloyd (2001), regional content protection gives rise to: a) the uncompetitive substitution of inputs; b) an increase in the price of the final product; c) the creation of a type of input quota with monopolistic tendencies; and d) the exploitation of this protection in order to ensure the acquisition of certain intermediate goods. Krishna and Krueger (1995) also point out that ROO may favour industrial linkages in the free trade area at the expense of competitiveness.
Ju and Krishna (1998) distinguish between ROO for inputs and ROO for final products and conclude that ROO for inputs simultaneously promote the creation of trade in final products and the diversion of trade in inputs. The simulation of a free trade area which is free from rules of origin led Ju and Krishna (1996) to a categorical conclusion: the absence of ROO stimulates trade creation. Adopting similar positions, Augier, Gasiorek and Lai-Tong (2003) compared two free trade areas, one with traditional ROO and the other with cumulation rules between countries. The main result was that the former agreement reduced expected trade by just over 50%. Estevadeordal (2000) demonstrated that the North American Free Trade Agreement (NAFTA) rules of origin respond to the same economic policy factors as tariffs. Finally, Suominen (2003; 2004) came to the same conclusions for the European Union.
Most authors support the protectionist argument by considering the price differential between regional and international inputs. The main point of the argument may be summarised in one sentence: if ROO protect the less efficient intermediate products produced within the free trade area then the substitution of inputs must be anticompetitive and damaging to welfare. Therefore, decision-making will seek to reduce or even eliminate origin requirements. However, the logic of this argument is distorted by a number of limitations which undermine its sensitivity in real cases. The weaknesses of the argument include the exclusion of: a) investment, a dynamic variable which can delimit anticompetitive effects and, through its creation, compensate for these effects4; b) wages, which are relevant in FTAs with significant wage differences; and c) administrative costs, which are especially onerous in the so-called “spaghetti bowls”. The following sections examine the importance of these variables and attempt to define the theoretical consequences of extending the standard argument.
Standard argument
For the purposes of this study it is first necessary to formalize the standard argument on the protectionist effects of ROO. According to the basic model6, A is the producer of a final product (Pf) and B is the producer of one of its inputs (I2). Both producers are located in two different countries within the same free trade area. It is assumed that the production process uses inputs I1, I2 and I3, where the value of I2 is equal to a fifth of the net cost (Cn) of the final product. (Note that labour L and capital C are constant.)

If the price of I2 is greater than the price of a perfect substitute produced outside the free trade area (I*), A would prefer to import the latter in order to reduce costs (I* < 1/5 NC). However, where ROO exist, exemption from tariffs or other restrictions on B’s exports may reduce the price of the input I2 by more than this difference between I2 and I* if the non-preferential tariff (MFN tariff) plus the price of I* is greater than 1/5 NC:

According to this model, ROO constitute a regulatory framework which is basically anticompetitive. Even if the value of I2 is equal to or lower than I*, ROO may be viewed as protectionist.
Wages as an explanatory variable
In order to introduce wages as an explanatory variable, let us consider the textile and apparel industry in NAFTA, a sector whose rules of origin are considered by many analysts to be particularly anticompetitive7. According to Graph 1, Mexican imports of cotton increased steadily between 1994 and 1998, while US imports of the same product slowed down notably and, except during the period between 1995 and 1996, have remained at relatively low levels. Graph 2 shows the simultaneous increase of US imports of a type of apparel which is produced in Mexico using imported cotton (heading 84151); Table 1 compares the graph lines for Mexican imports of raw cotton and Mexican exports of cotton apparel to the United States. The correlation coefficient of 0.834 for the period 1994-2007 reflects the close link between these flows.
The data suggests that the North Atlantic Free Trade Agreement leads to the substitution of cotton suppliers in two senses: a) Mexican producers absorb a large proportion of imports of intermediate goods (cotton) previously acquired by US firms; b) the US increase imports of Mexican final products, presumably replacing suppliers outside the US.
What function do preferential ROO perform in this double process? An exhaustive response to this question is beyond the scope of this article; what is of most interest here is that the substitution of inputs and final products is mainly explained by the value of outsourcing, which is in turn explained by wage differences in the NAFTA territories. In order to capture this phenomenon we must break the labour variable down into the higher manufacturing wage per hour (W1) in one country and the lower manufacturing wage per hour in another country (W2). If we incorporate these W values into equation 2, two extreme cases are possible. In the first, the price difference between regional and international inputs is greater than the wage difference between the two member countries of the free trade area (I* - I2 > W1 - W2). In the second, the difference between regional and international prices is smaller than the wage difference (I* - I2 < W1 - W2).
ROO can only cause trade diversion in the first case. This happens because they increase production costs through the anticompetitive substitution of inputs. In the second case, however, the substitution of suppliers is motivated by an effort to achieve greater competitiveness by taking advantage of lower regional wages. If the wage difference is important, the rule of origin becomes secondary in explaining the substitution of suppliers, subject to the combination of optimization parameters.
The specific features of the U.S. regime illustrate this second case. The tariff preferences offered by U.S. rules to Mexican maquilas (4% tariff rate) are far greater than those offered by Asia (56% tariff rate) or even Central America (14% before the Dominican Republic-Central America Free Trade Agreement, CAFTA-DR, entered into effect.)8 However, the fact that wages in the manufacturing industry in Mexico are eight times lower than in the United States means that wages are the main determining factor in the substitution of suppliers.
Administrative complications of ROO
The intricate rules of origin process begins with three methods of calculation. The change in tariff classification (CTC) method, the most widely used rule, confers originating status to products that have undergone a substantial transformation or “shift” from one chapter (or heading) to another under the Harmonized Commodity Description and Coding System (HS)9. If the goods don’t meet this requirement the business has recourse to two additional methods. The transaction value (TV) or net cost (NC) method is mainly used for chemical products, footwear and machinery. It is calculated using the following formula:
RVC = TV – VNM / TV • 100
where RVC represents the regional value content and VNM is the value of non-originating materials. (The NC method uses the same formula, adjusting the RVC to the percentage established in the agreement.) If the goods don’t qualify even after applying the second method the business can avail of a third method known as cumulation. This method confers originating status to a product if its inputs are produced using intermediate materials from outside the area. Used in fewer cases, cumulation is achieved by breaking the production process down into identifiable parts in order to recover inputs and intermediate costs from within the free trade area11. The relationship between these methods may be viewed as a simple flowchart (Figure 1).
However, the selection of methods isn’t the same under all agreements. The LAIA only provides for the CTC method. NAFTA, whose origin regime is plagued by specific rules, recognises changes in tariff classification as well as those methods which are based on establishing where foreign parts are manufactured, where the product is packaged and where the last stage of manufacturing takes place. Under this agreement, method selection is subject to a hierarchy of six rules (Figure 2)12.
Greater complications arise when there is overlapping of several trade agreements, especially when there are variations in origin specifications, customs procedures, dispute resolution mechanisms, the functions of special committees, the administration of requirements, or opportunities for adding flexibility to a rule for a particular product. These complications are exacerbated when there are numerous tariff baskets. This is not uncommon; when a Mexican firm exports man-made filaments (included in the group 54 011 001) to countries with which it has no agreements, the product is subject to an MFN tariff of 18%. When it falls under the scope of a free trade agreement, the tariffs are: zero (at the end of the period of transition) under NAFTA and under Mexico’s free trade agreements with Costa Rica, Chile, Nicaragua, the European Union and Israel; 2.5% under its free trade agreement with Bolivia; 4.5% and 5.5% under its free trade agreement with Columbia (the G-3) and 12% when the LAIA’s tariff preference is applied (under the G-3 free trade agreement with Venezuela, for example).
Estimation of administrative costs
These complications are clearly beyond the knowledge of the average business although this doesn’t mean that they can be neglected. The costs incurred by a firm in order to successfully administer the ROO for a product include13: a) the employment of staff to process invoices and certificates; b) the adaptation of the production process in order to comply with the requirements of different ROO (with the consequent risk of anticompetitive substitution of inputs); c) the occasional hiring of experts in customs law (mainly when the authorities in the importing country claim that underinvoicing has taken place or ask for additional information because they suspect that it has taken place); d) the recruitment of consultants, who develop negotiating strategies for new agreements or the revision of existing ones; e) greater susceptibility to administrative errors or incomplete, unreliable or scattered information; and f) an increase in the firm’s response times due to the number of agreements and the specificities of these agreements.
What is the administrative cost of ROO from the point of view of the exporter? In Brazil, the organisation which handles origin procedures charges between 6 and 20 dollars per shipment. In Chile, the fee amounts to 7 dollars (Estevadeordal y Suominen, 2005). The processing of documentation in the European Free Trade Association fluctuated between 3% and 5% of the FOB value of the goods in the initial stages of its operation (Herin, 1986). In Finland firms paid between 1.4% and 5.7% of the value of exports (Koskinen, 1983). In Mexico certification is free, although some studies suggest that exportation according to the provisions of NAFTA or other agreements also incurs unspecified costs (Cadot et al., 2002)14.
Taking these variations into account, let us consider a medium-sized company which has an average turnover and administrative staff for a synthetic fibre manufacturer in Mexico (sales of US $10 million; 500 workers). Generally, the wage of an administrative worker is equivalent to US $10 per hour. The different origin procedures require 10 hours of work for every shipment of 1000 items. If the price of each item is US $10 the shipment will have a value of US $10,000 plus packing and transport costs.
If the shipment falls within the scope of one agreement or rule or is being exported to only one preferential destination, the administrative cost is equivalent to US $0.10 per item. If the same shipment falls within the scope of two different agreements (500 items per agreement) the cost almost doubles. This is due to partial integration of administrative activities. If the firm exports under two or more agreements the cost increases as a function of the coefficient (L), which represents the limit to the integration of administrative activities or the irreducibility of certain tasks.
This situation may be expressed using (L) and equations 3, 4 and 5. These equations express the costs of ROO as a function of the number of export markets that a firm possesses. The administrative cost (C) is a function of (x) or the increase in costs as a result of the overlapping of origin regimes15.

At the other extreme, the coefficient (L) increases the cost of diversification to such an extent that the firm prefers to concentrate on one market. Both scenarios depend on the difference between the preferential tariffs and the MFN tariffs applied by the importing country.
It is worth noting that the value of (L) does not need to be high; if this value approaches the non-preferential tariff of the importing country, the value of (CL) reduces the benefits of the agreement and the agreement becomes irrelevant compared to other factors (market size, transport costs, product competitiveness).
From these equations we can draw a general conclusion. “Spaghetti bowls” invalidate theoretical predictions about the protectionist behaviour of ROO and highlight the administrative dimension of preferential trade. The protectionist intention, if it exists, is outweighed by the extensive complications of the regulatory framework, which eventually affect the supposedly protected business. Unlike tariffs, which in principle contribute to tax revenues and are geared towards infant industry protection, the increased administrative costs act as a drain on resources.
