О ПОРЯДКЕ РАССМОТРЕНИЯ И ИСПОЛНЕНИЯ
В ОРГАНАХ ПРОКУРАТУРЫ РОССИЙСКОЙ ФЕДЕРАЦИИ
ПОРУЧЕНИЙ ОБ ОСУЩЕСТВЛЕНИИ УГОЛОВНОГО ПРЕСЛЕДОВАНИЯ,
ЗАПРОСОВ О ПРАВОВОЙ ПОМОЩИ ИЛИ О ВОЗБУЖДЕНИИ УГОЛОВНОГО
ДЕЛА, ПОСТУПИВШИХ ОТ КОМПЕТЕНТНЫХ ОРГАНОВ
ИНОСТРАННЫХ ГОСУДАРСТВ
В целях обеспечения соблюдения международных обязательств и законодательства Российской Федерации по оказанию правовой помощи компетентным органам иностранных государств, соблюдения прав и свобод человека и гражданина, руководствуясь ст. 17 Федерального закона "О прокуратуре Российской Федерации", обязываю:
1. Установить в органах прокуратуры Российской Федерации следующий порядок рассмотрения и исполнения поручений об осуществлении уголовного преследования, запросов о правовой помощи или о возбуждении уголовного дела, поступивших в Генеральную прокуратуру Российской Федерации от компетентных органов иностранных государств:
1.1. Организацию работы по рассмотрению и исполнению запросов и поручений компетентных органов иностранных государств возложить на Главное управление международно-правового сотрудничества.
1.2. Главным управлениям и управлениям Генеральной прокуратуры Российской Федерации, Главной военной прокуратуре, Следственному комитету при прокуратуре Российской Федерации, прокурорам субъектов Российской Федерации, приравненным к ним прокурорам специализированных прокуратур:
1.2.1. Обеспечить исполнение запросов и поручений, поступивших от компетентных органов иностранных государств через Генеральную прокуратуру Российской Федерации, в строгом соответствии с уголовно-процессуальным законодательством Российской Федерации, если иное не установлено международным договором Российской Федерации.
1.2.2. Материалы, полученные в ходе исполнения запросов о правовой помощи, заверенные в установленном порядке в соответствии с международным договором и законодательством Российской Федерации, представлять в Главное управление международно-правового сотрудничества, если иное не определено международным договором Российской Федерации.
1.3. Главному управлению международно-правового сотрудничества:
1.3.1. Осуществлять тщательную проверку поступивших от компетентных органов иностранных государств запросов и поручений на соответствие международным договорам Российской Федерации, а в отсутствие таких договоров - принципу взаимности и законодательству Российской Федерации, организовывать их исполнение.
1.3.2. При необходимости запрашивать мнения уполномоченных федеральных органов исполнительной власти о возможности исполнения запроса о правовой помощи компетентного органа иностранного государства.
В случае, если исполнение запроса о правовой помощи противоречит законодательству Российской Федерации либо может нанести ущерб ее суверенитету или безопасности, подготавливать проекты документов для принятия руководством Генеральной прокуратуры Российской Федерации решения об отказе в исполнении ходатайства.
1.3.3. Для организации исполнения надлежаще оформленные запросы о правовой помощи:
о производстве процессуальных действий, отнесенных к компетенции следователя (в том числе о вручении документов и вызове участников уголовного судопроизводства), направлять в центральные аппараты органов предварительного следствия в соответствии с подследственностью, установленной ст. 151 УПК РФ, за исключением иного порядка, установленного настоящим указанием;
о производстве действий, отнесенных к компетенции прокурора (о передаче на время лица, находящегося под стражей или отбывающего наказание в виде лишения свободы, по вопросам реабилитации, применения амнистии и др.), направлять в главные управления и управления Генеральной прокуратуры Российской Федерации, прокурорам субъектов Российской Федерации и приравненным к ним прокурорам специализированных прокуратур, за исключением иного порядка, установленного настоящим указанием;
в случаях, предусмотренных международными договорами Российской Федерации и законодательством об их ратификации, направлять в иные уполномоченные органы.
1.3.4. Поручения об осуществлении уголовного преследования, запросы о правовой помощи или о возбуждении уголовного дела в отношении военнослужащих и иных лиц, относящиеся к компетенции органов военной прокуратуры и поднадзорных им органов предварительного следствия, направлять для рассмотрения в Главную военную прокуратуру.
1.3.5. Запросы о правовой помощи по уголовным делам о преступлениях экстремистской и террористической направленности, шпионаже, а также в отношении лиц, совершивших преступления против мира и безопасности человечества, направлять для рассмотрения в управление по надзору за исполнением законов о федеральной безопасности, межнациональных отношениях и противодействии экстремизму.
1.3.6. Отвечающие необходимым требованиям материалы по принятым к исполнению поручениям об осуществлении уголовного преследования или запросам о возбуждении уголовного дела направлять прокурорам субъектов Российской Федерации с соответствующим поручением в отношении указанных в ходатайстве лиц по месту их постоянного жительства или пребывания, за исключением иного порядка, установленного настоящим указанием.
1.3.7. О направлении прокурору субъекта Российской Федерации уголовного дела или материалов уведомлять соответствующие подразделения Генеральной прокуратуры Российской Федерации, осуществляющие надзор за процессуальной деятельностью органов предварительного расследования.
1.3.8. Обеспечить своевременность и полноту исполнения запросов о правовой помощи.
1.3.9. В случае выявления нарушений норм федерального законодательства, допущенных следственными органами при исполнении запроса о правовой помощи, подготавливать проекты документов для внесения руководством Генеральной прокуратуры Российской Федерации требования об устранении нарушений федерального законодательства в порядке, предусмотренном УПК РФ.
1.3.10. Направлять материалы, полученные при исполнении запросов о правовой помощи, в соответствующие компетентные органы иностранного государства в порядке, установленном законодательством Российской Федерации.
1.3.11. Уведомлять компетентные органы иностранных государств о результатах исполнения поручений об осуществлении уголовного преследования и запросов о возбуждении уголовного дела в соответствии с требованиями международных договоров Российской Федерации.
1.4. Главной военной прокуратуре рассматривать поступившие поручения об осуществлении уголовного преследования, запросы о правовой помощи или о возбуждении уголовного дела в отношении военнослужащих и других лиц в пределах своей компетенции, организовывать их исполнение нижестоящими прокурорами и поднадзорными органами предварительного следствия в порядке, не противоречащем настоящему указанию, о результатах информировать Главное управление международно-правового сотрудничества.
1.5. Управлению по надзору за исполнением законов о федеральной безопасности, межнациональных отношениях и противодействии экстремизму в пределах своей компетенции рассматривать поступившие запросы о правовой помощи по уголовным делам о преступлениях экстремистской и террористической направленности, шпионаже, а также в отношении лиц, совершивших преступления против мира и безопасности человечества, организовывать их исполнение нижестоящими прокурорами и поднадзорными органами предварительного следствия в порядке, не противоречащем настоящему указанию, о результатах информировать Главное управление международно-правового сотрудничества.
1.6. Подразделениям Генеральной прокуратуры Российской Федерации, осуществляющим надзор за процессуальной деятельностью органов предварительного расследования:
1.6.1. После получения информации о направлении прокурору субъекта Российской Федерации уголовного дела или материалов, поступивших от компетентных органов иностранного государства, в пределах установленных законом полномочий принимать меры по обеспечению оперативного и квалифицированного расследования, соблюдению прав и свобод человека и гражданина, принятию законных и обоснованных решений.
1.6.2. Уделять особое внимание правомерности отказа в возбуждении или прекращения уголовного дела, а также приостановления предварительного расследования, истребовать такие дела или материалы для проверки в порядке надзора, о результатах проверки информировать Главное управление международно-правового сотрудничества.
1.7. Главному управлению по обеспечению участия прокуроров в рассмотрении уголовных дел судами организовывать проверку законности, обоснованности и справедливости судебных решений, принятых по результатам рассмотрения уголовных дел, переданных компетентными органами иностранных государств с поручениями об осуществлении уголовного преследования либо возбужденных в соответствии с международным договором Российской Федерации, о результатах проверки информировать Главное управление международно-правового сотрудничества.
1.8. Прокурорам субъектов Российской Федерации, приравненным к ним военным прокурорам и прокурорам иных специализированных прокуратур:
1.8.1. Организовывать исполнение поступивших из Генеральной прокуратуры Российской Федерации поручений об осуществлении уголовного преследования и запросов о правовой помощи или о возбуждении уголовного дела на территории Российской Федерации.
Обеспечивать надзор за соблюдением требований уголовно-процессуального законодательства Российской Федерации, прав и свобод граждан, принятием законных решений при расследовании поступивших уголовных дел и проведении проверок в порядке, предусмотренном ст. 144, 145 УПК РФ.
1.8.2. В пределах установленных законом полномочий проверять полноту исполнения запросов о правовой помощи.
1.8.3. В случае невозможности исполнения запросов о правовой помощи незамедлительно информировать Генеральную прокуратуру Российской Федерации.
1.8.4. При получении информации о состоявшемся процессуальном решении в результате исполнения поручения об осуществлении уголовного преследования или запроса о возбуждении уголовного дела на территории Российской Федерации организовывать проверку его законности и обоснованности, о результатах незамедлительно информировать подразделение Генеральной прокуратуры Российской Федерации, направившее поручение или запрос, а также подразделение Генеральной прокуратуры Российской Федерации, осуществляющее надзор за процессуальной деятельностью органов, проводивших проверку этих материалов или расследование по данному уголовному делу, с представлением последнему заключения о законности и обоснованности принятого решения в случае отказа в возбуждении или прекращения уголовного дела.
2. Считать утратившим силу указание Генерального прокурора Российской Федерации от 22.04.2003 N 18/35 "О порядке исполнения запросов компетентных органов иностранных государств об осуществлении уголовного преследования или о возбуждении уголовного дела на территории Российской Федерации".
3. Контроль за исполнением настоящего указания возложить на заместителей Генерального прокурора Российской Федерации по направлениям деятельности.
Указание направить первым заместителям и заместителям Генерального прокурора Российской Федерации, начальникам главных управлений и управлений Генеральной прокуратуры Российской Федерации, прокурорам субъектов Российской Федерации, приравненным к ним военным прокурорам и прокурорам иных специализированных прокуратур, которым довести его содержание до сведения подчиненных работников.

ORDINANCE
No. 68/35 dated 12 March 2009
CONCERNING THE PROCEDURE FOR THE CONSIDERATION AND EXECUTION BY
RUSSIAN PROSECUTION AUTHORITIES OF REQUESTS
TO INITIATE CRIMINAL PROSECUTION/PROCEEDINGS AND FOR LEGAL ASSISTANCE SUBMITTED
BY FOREIGN COMPETENT AUTHORITIES
With a view to ensuring the fulfilment of Russia's international commitments to the provision of legal assistance to foreign competent authorities, compliance with its laws governing the same, and observance of human and citizen's rights and freedoms, being guided by Art. 17 of the Federal Law "On the Prosecutor's Office of the Russian Federation", I hereby order as follows:
1. To establish the following procedure for the consideration and execution by Russian prosecution authorities of requests to initiate criminal prosecution/proceedings and for legal assistance submitted to the General Prosecutor's Office of the Russian Federation by foreign competent authorities:
1.1. The responsibility for the consideration and execution of requests from foreign competent authorities shall be assigned to the General Directorate for International Legal Cooperation.
1.2. General directorates and directorates of the General Prosecutor’s Office of the Russian Federation, the Chief Military Prosecutor’s Office, the Investigative Committee under the Prosecutor’s Office of the Russian Federation, prosecutors of the constituent entities of the Russian Federation, and prosecutors of the specialized prosecutor’s offices of equal status, shall:
1.2.1. Ensure the execution of requests submitted by foreign competent authorities through the General Prosecutor's Office of the Russian Federation, in strict compliance with the criminal procedure laws of the Russian Federation, unless otherwise stipulated in international treaties of the Russian Federation.
1.2.2. Make the information obtained in the course of the execution of requests for legal assistance, certified in the prescribed manner in accordance with international treaties and laws of the Russian Federation, available to the General Directorate for International Legal Cooperation, unless otherwise stipulated in international treaties of the Russian Federation.
1.3. The General Directorate for International Legal Cooperation shall:
1.3.1. Ensure strict compliance of the requests submitted by foreign competent authorities with international treaties of the Russian Federation or, in the absence thereof, with the principle of reciprocity and applicable laws of the Russian Federation, and arrange for their execution.
1.2.3. Where necessary, solicit the opinion of the competent federal agencies with regard to the possible execution of a request for legal assistance from a foreign competent authority.
Where the execution of a request for legal assistance runs contrary to legal requirements in place in the Russian Federation or may damage its sovereignty or security, prepare draft documents for a decision by the General Prosecutor’s Office of the Russian Federation to refuse to execute the request.
1.3.3. In order to arrange for the execution of duly prepared requests for legal assistance:
in initiating proceedings falling under the competence of the investigator (including in delivering documents and summoning the participants in criminal proceedings), send the same to the central offices of preliminary investigation authorities in accordance with jurisdiction established by Art. 151 of the RF Code of Criminal Procedure, except as otherwise provided herein;
in performing actions falling under the competence of the prosecutor (in transferring, on a temporary basis, a person held in custody or serving a prison sentence, as well as with respect to issues concerning rehabilitation, application of amnesty, etc.), send the same to the general directorates and directorates of the General Prosecutor's Office of the Russian Federation, prosecutors of the constituent entities of the Russian Federation and prosecutors of the specialized prosecutor’s offices of equal status, except as otherwise provide herein;
to the extent provided by international treaties of the Russian Federation and laws governing their ratification, send the same to other competent authorities.
1.3.4. Send to the General Military Prosecutor’s Office for consideration, requests to initiate criminal prosecution, for legal assistance or to initiate criminal proceedings against military personnel and other persons, that fall within the competence of the military prosecutor’s office and accountable preliminary investigation authorities.
1.3.5. Send to the Directorate for Monitoring the Implementation of the Laws on Federal Security, Interethnic Relations and Countering Extremism for consideration, requests for legal assistance in criminal investigations into extremist/terrorist offences, espionage, as well as against persons who have committed crimes against the peace and security of mankind.
1.3.6. Send to the prosecutors of the constituent entities of the Russian Federation, along with appropriate instructions regarding the persons specified in the request, at the place of such persons' permanent residence or current address, the requisite information on accepted requests to initiate criminal prosecution/proceedings, except as otherwise provided herein.
1.3.7. Notify the relevant units of the General Prosecutor's Office of the Russian Federation responsible for monitoring the work of the preliminary investigation authorities of the decision to send criminal case files or information to the prosecutor of the constitute entity of the Russian Federation.
1.3.8. Ensure the timely and proper execution of requests for legal assistance.
1.3.9. In the event of any violations of federal regulations committed by investigating authorities executing a request for legal assistance, prepare draft documents for the issuance of a request by the General Prosecutor's Office of the Russian Federation to eliminate the violations of federal regulations in the manner prescribed by the Code of Criminal Procedure of the Russian Federation.
1.3.10. Send the information obtained in the course of execution of requests for legal assistance to the relevant foreign competent authorities in the manner prescribed by applicable law of the Russian Federation.
1.3.11. Notify foreign competent authorities about any progress in the execution of requests to initiate criminal prosecution/proceedings in accordance with the requirements of the international treaties of the Russian Federation.
1.4. The Chief Military Prosecutor’s Office shall review incoming requests to initiate criminal prosecution, for legal assistance or to initiate criminal proceedings against military personnel and other persons, that fall within the competence of the military prosecutor’s office, arrange for their execution by lower-ranking prosecutors and accountable preliminary investigation authorities in a manner not inconsistent with this ordinance, and report the outcomes thereof to the General Directorate for International Legal Cooperation.
1.5. The Directorate for Monitoring the Implementation of the Laws on Federal Security, Interethnic Relations and Countering Extremism shall, within its competence, consider the incoming requests for legal assistance in criminal investigations into extremist/terrorist offences, espionage, as well as against persons who have committed crimes against the peace and security of mankind, arrange for their execution by lower-ranking prosecutors and accountable preliminary investigation authorities in a manner not inconsistent with this ordinance, and report the outcomes thereof to the General Directorate for International Legal Cooperation.
1.6. The units of the General Prosecutor's Office of the Russian Federation responsible for monitoring the work of the preliminary investigation authorities shall:
1.6.1. After being notified of the submission to the prosecutor of the constituent entity of the Russian Federation of a criminal case file or information submitted by foreign competent authorities, to the extent permitted by law, take steps to ensure a prompt and proper investigation, respect for human and civil rights and freedoms, and adoption of legitimate and well-founded decisions.
1.6.2. Pay special attention to the lawfulness of the decision to refuse to initiate or terminate criminal proceedings, as well as to suspend the preliminary investigation, request such criminal files or information for an audit as part of oversight procedures, and report the findings thereof to the General Directorate for International Legal Cooperation.
1.7. The Main Directorate for Ensuring Prosecutors' Participation in the Hearing of Criminal Cases by Courts shall verify the legality, justifiability and fairness of judicial decisions taken based on the outcomes of the hearings of criminal cases submitted by foreign competent authorities alongside requests to initiate criminal prosecution, or initiated in accordance with international treaties of the Russian Federation, and report the findings thereof to the General Directorate for International Legal Cooperation.
1.8. Prosecutors of the constituent entities of the Russian Federation, military prosecutors and prosecutors of other specialized prosecutor’s offices of equal status shall:
1.8.1. Arrange for the execution of requests submitted by the General Prosecutor's Office of the Russian Federation to initiate criminal prosecution, for legal assistance or to initiate criminal proceedings in the territory of the Russian Federation.
Monitor compliance with criminal procedure laws of the Russian Federation, observance of the rights and freedoms of citizens and adoption of legitimate decisions in investigating incoming criminal cases and conducting inspections in the manner provided for in Arts. 144 and 145 of the Code of Criminal Procedure of the Russian Federation.
1.8.2. To the extent permitted by law, verify the completeness of the execution of requests for legal assistance.
1.8.3. Where it is not possible to execute requests for legal assistance, immediately notify the General Prosecutor's Office of the Russian Federation.
1.8.4. Upon being notified of a procedural decision taken in response to the execution of a request to initiate criminal prosecution or proceedings in the territory of the Russian Federation, verify its legitimacy and justifiability and promptly report the findings thereof to the unit of the General Prosecutor’s Office of the Russian Federation that sent such request, as well as to the unit of the General Prosecutor’s Office of the Russian Federation responsible for monitoring the work of the preliminary investigation authorities involved in the verification of this information or investigation of this criminal case, followed by the submission to the latter of the conclusion as to the legitimacy and justifiability of the decision taken in the case of refusal to initiate or termination of criminal proceedings.
2. Consider to be null and void the ordinance of the General Prosecutor's Office of the Russian Federation No. 18/35 dated April 22, 2003 "On the procedure for the execution of requests from foreign competent authorities to initiate criminal prosecution or proceedings in the territory of the Russian Federation".
3. The responsibility for enforcing this ordinance shall be assigned to the deputies of the General Prosecutor of the Russian Federation as per their line of work.
Circulate copies of this ordinance among the deputies of the General Prosecutor of the Russian Federation, heads of general directorates and directorates of the General Prosecutor's Office of the Russian Federation, and prosecutors of the constituent entities of the Russian Federation, military prosecutors and prosecutors of other specialized prosecutor's offices of equal status, who shall bring it to the attention of subordinate employees.

__________________________ (далее «C...») именуемое в дальнейшем «Исполнитель»,
Общество с ограниченной ответственностью «Урбан...», Республика Беларусь, компания с номером 193005330, зарегистрированная в соответствии с законодательством Республики Беларусь, по адресу: 226610, ..., именуемое в дальнейшем «Заказчик», в лице Директора ..., действующего на основании Устава, с другой стороны,
именуемые в дальнейшем «Стороны», заключили настоящий договор, в дальнейшем «Договор», о нижеследующем:
1. ПРЕДМЕТ ДОГОВОРА
1.1. В соответствии с условиями настоящего Договора Исполнитель обязуется в течение срока действия настоящего Договора оказывать, а Заказчик обязуется принимать и оплачивать следующие услуги:
- инструктаж персонала Заказчика о принципах, концепции и формате сети ...;
- консультации по обеспечению продвижения товара и бренда ... на рынке Республики Беларусь;
- консультации по обеспечению организации торгового процесса в кофейнях Заказчика;
- консультации по вопросам состава оборудования в кофейнях;
- консультации по поиску и подбору объектов недвижимости для открытия кофеен;
- консультации и помощь в проведении необходимой оценки помещения или локации на предмет экономической целесообразности и соответствия требованиям формата сети ...;
- разработка рекомендаций по организации охраны объекта, использованию систем видеонаблюдения в кофейнях;
- консультирование по вопросам снижения потерь от хищений со стороны персонала кофеен;
- консультации и оказание содействия в переговорах с собственниками объектов с целью достижения максимально выгодных для Заказчика условий в рамках согласования договоров аренды;
- консультации по заказу дополнительного оборудования;
- консультации по формированию ассортимента товара для кофеен Заказчика;
- консультации по созданию системы логистики;
- проведение кратких тренингов об основах мерчендайзинга;
- консультации по обеспечению рекламой при внутреннем оформлении кофеен;
- консультации по расстановке торгового оборудования на объектах Заказчика;
- общее кураторство, консультации по исправлению недостатков и совершенствованию процесса осуществления торговой деятельности;
- консультации по адаптации и реализации маркетинговых программ в Республике Беларусь;
- иные услуги по согласованию сторон.
1.3. Срок оказания Услуг с «11» мая 2018г. по «01» декабря 2018г.
1.4. Услуги оказываются на территории Республики Беларусь по месту нахождения кофеен Заказчика. По договоренности Сторон Услуги могут быть оказаны в другом месте - Кипр, Никосия.
1.5. Исполнитель передает, а Заказчик принимает право на использование товарного знака Исполнителя «C...», регистрационный номер в Мадридской системе ... (http://www.wipo.int), а Заказчик обязуется уплатить Исполнителю обусловленное настоящим Договором вознаграждение.
1.6. Заказчику передается право на использование товарного знака в полном объеме, в любой форме и любым не противоречащим законодательством способом, в том числе для индивидуализации товаров (работ, услуг).
1.7. Право на использование товарного знака Исполнителя «C...» предоставляется Заказчику на период с 11.05.2018 по 01.12.2018.
2. ПРАВА И ОБЯЗАННОСТИ ИСПОЛНИТЕЛЯ
2.1. Исполнитель обязан оказать услуги надлежащим образом, а также в установленный Договором срок. Исполнитель обязан передать Заказчику результаты услуг по электронным каналам связи.
2.2. Исполнитель обязан немедленно предупредить Заказчика и до получения от него указаний приостановить оказание услуг при обнаружении:
2.2.1. возможных неблагоприятных для Заказчика и (или) Исполнителя последствий выполнения его указаний о способе оказания услуг;
2.2.2. иных независящих от Исполнителя обстоятельств, которые препятствуют оказанию услуги либо создают невозможность ее завершения в срок;
2.2.3. не разглашать конфиденциальную информацию Заказчика;
2.3. Исполнитель обязан безвозмездно устранить по требованию Заказчика выявленные недостатки.
2.4. Исполнитель имеет право отказаться от исполнения обязательств по Договору при условии полного возмещения Заказчику убытков, включая реальный ущерб и упущенную выгоду.
3. ПРАВА И ОБЯЗАННОСТИ ЗАКАЗЧИКА
3.1. Заказчик обязан принять и оплатить оказанные услуги в размере и сроки, предусмотренные настоящим Договором.
3.2. В случае выявления нарушений в ходе оказания услуг, необходимости оказания дополнительных услуг, Заказчик незамедлительно письменно информирует об этом Исполнителя.
3.3. Заказчик вправе контролировать ход оказания услуг, в том числе путем визуального осмотра торговых залов объектов.
3.4. Заказчик имеет право:
3.4.1. контролировать выполнение Исполнителем Услуг;
3.4.2. отказаться от договора и потребовать возмещения убытков, если Исполнитель не приступает своевременно к исполнению договора или оказывает услугу настолько медленно, что окончание ее к сроку становится явно невозможным;
3.4.3. отказаться от исполнения договора в любое время до сдачи ему результата оказания услуг, уплатив Исполнителю часть установленной цены пропорционально части услуги, оказанной к моменту расторжения договора.
4. ПОРЯДОК ОКАЗАНИЯ УСЛУГ
4.1. Услуги оказываются по заданию Заказчика, в соответствии с условиями договора.
4.2. Стороны соглашаются с тем, что перечень оказываемых Услуг по настоящему договору не является исчерпывающим и может корректироваться по согласованию Сторон.
4.3. Оказание услуг Исполнителем подтверждается подписанием Сторонами Акта об оказании услуг, который также является отчетом об оказанных по настоящему договору услугах.
4.4. Не позднее последнего дня срока действия настоящего договора Стороны обязуются подписать Акт об оказании услуг в котором указывается перечень оказанных услуг по настоящему договору.
При этом, Стороны вправе подписать Акты об оказании услуг за иные согласованные периоды (сроки, этапы) оказания услуг в пределах срока действия настоящего договора.
5. СТОИМОСТЬ УСЛУГ, ПОРЯДОК И СРОКИ РАСЧЕТОВ
5.1. Все расчеты между Заказчиком и Исполнителем осуществляются в безналичном порядке и производятся в долларах США.
5.2. Расчет за оказанные услуги производится Заказчиком в размере и в сроки, указанные в Акте оказанных услуг, но не позднее 10 рабочих дней с даты подписания сторонами Акта оказанных услуг.
5.3. Общая и окончательная Стоимость Услуг составляет __________ долларов США.
5.4. Если Исполнитель, по каким бы то ни было причинам, не выполнит принятых на себя обязательств полностью/или в части, то в указанном случае он обязуется возвратить Заказчику денежные средства за вычетом стоимости фактически оказанных услуг. Данный возврат должен быть произведен в течение 30 календарных дней с момента предъявленного соответствующего требования от Заказчика.
5.7. В случае оказания услуг на условиях получения предоплаты срок оказания услуг не может превышать 60 календарных дней с момента получения предварительной оплаты.
5.8. Вознаграждение за право использования товарного знака «C...» за период согласно п.1.7. настоящего договора составляет ____________ долларов США.
5.9. Вознаграждение за право использования товарного знака «C...» перечисляется Исполнителю после подписания Сторонами Акта оказанных услуг в течении 10 рабочих дней.
6. РЕШЕНИЕ СПОРНЫХ ВОПРОСОВ
6.1.Все споры и разногласия, которые могут возникнуть из настоящего Договора, будут, по возможности, разрешаться путем переговоров между сторонами.
6.2.В случае если Стороны не могут прийти к соглашению, спор передается на рассмотрение суда по месту нахождения истца.
7. СРОК ДЕЙСТВИЯ ДОГОВОРА
7.1. Договор вступает в силу с момента его подписания обеими Сторонами и действует до 01 декабря 2018 г. включительно, но в любом случае до полного исполнения Сторонами своих обязательств по Договору.
7.2. Сроки действия Договора могут изменяться в случае объективных причин, признаваемых обеими Сторонами.
7.3. Договор может быть расторгнут досрочно, по взаимному, письменному согласию Сторон. Сторона, желающая расторгнуть Договор обязана уведомить вторую Сторону не позднее 20 (двадцати) до даты расторжения Договора.
8. ОТВЕТСТВЕННОСТЬ СТОРОН
8.1. Стороны несут ответственность за исполнение своих обязанностей по Договору в соответствии с действующим законодательством Республики Беларусь.
8.2. В случае нарушения Исполнителем сроков оказания услуг по настоящему Договору Заказчик вправе взыскать с Исполнителя неустойку в размере 0,1% от общей суммы несвоевременно оказанных услуг. Уплата неустойки не освобождает Исполнителя от его обязательств по Договору.
8.3. В случае нарушения Заказчиком сроков оплаты услуг по настоящему Договору Исполнитель вправе взыскать с Заказчика неустойку в размере 0,1% от общей суммы несвоевременно оплаченных услуг. Уплата неустойки не освобождает Заказчика от его обязательств по Договору.
Стороны пришли к обоюдному согласию, что штрафные санкции могут быть начислены и представлены к взысканию лишь в том случае, если будет соблюден претензионный порядок.
9. ФОРС-МАЖОР
9.1. Стороны освобождаются от ответственности за частичное или полное неисполнение своих обязательств по настоящему Договору, если такое неисполнение явилось следствием обстоятельств непреодолимой силы, возникших после заключения Договора в результате событий чрезвычайного характера, таких как землетрясение, пожар, наводнение, прочие стихийные бедствия, эпидемии, аварии, взрывы, военные действия, изменения законодательства, повлекших за собой невозможность выполнения Сторонами своих обязательств по настоящему Договору. Данный перечень является исчерпывающим.
10. ПРОЧИЕ УСЛОВИЯ
10.1. Стороны гарантируют неразглашение конфиденциальной информации, ставшей известной им в ходе исполнения настоящего договора. Сам факт заключения и предмет настоящего договора является конфиденциальной информацией.
10.2. Стороны пришли к соглашению при исполнении настоящего Договора осуществлять переписку, извещения, оформлять, представлять документы и (или) обмениваться документами, информацией с использованием средств электронной связи и адресов электронной почты (с доменов: ___________________________), согласованных Сторонами дополнительно и/или указанных в разделе «Реквизиты и подписи Сторон». При этом, Стороны соглашаются с тем, что переданные вышеуказанным способом документы признают действующими и имеющими юридическую силу до получения оригиналов документов.
10.2. Все изменения и дополнения к настоящему Договору имеют силу, если они совершены в письменной форме и подписаны уполномоченными представителями обеих Сторон.
10.3. Договор составлен на русском языке и на английском языке. В случае противоречия русской и английской версии, приоритет имеет версия на английском языке.

Translation - English SERVICE AGREEMENT

__________________________ (hereinafter "C..."), hereinafter referred to as the "Contractor," of the one part, and
Urban... Limited Liability Company, Belarus, company registration number 193005330, incorporated under the laws of the Republic of Belarus, having its principle place of business at: 226610, ..., hereinafter referred to as the "Customer," represented by Director Andrei ..., acting on the basis of the Charter, of the other part,
collectively referred to as the "Parties," have entered into this Services Agreement, hereinafter the "Agreement," as follows:
1. SUBJECT MATTER
1.1. In accordance with the terms and conditions of this Agreement, the Contractor agrees to perform throughout the term of this Agreement, and the Customer agrees to accept and pay for, the following services:
- briefing the Customer's personnel on the principles, concepts and format of the C... chain;
- advising the Customer on ways to promote the C... brand and products in the Belorussian market;
- advising the Customer on the operation of the Customer's coffee shops;
- advising the Customer on the equipment to be installed in the coffee shops;
- advising the Customer on finding the best locations for new coffee shops;
- advising and assisting the Customer on/in carrying out the necessary assessment of the premises or location in terms of economic feasibility and compliance with the C... chain format requirements;
- development of recommendations for protecting the facility and using video surveillance systems in the coffee shops;
- advising the Customer on ways to reduce the losses caused by employee theft;
- advising and assisting the Customer on/in holding negotiations with property owners with a view to obtaining the most favorable for the Customer lease terms;
- advising the Customer on the placement of orders for additional equipment;
- advising the Customer on the menu for the Customer's coffee shops;
- advising the Customer on the setting up of a logistics system;
- holding brief trainings on the fundamentals of merchandising;
- advising the Customer on indoor advertising;
- advising the Customer on the placement of shop fixtures and equipment at the Customer's facilities;
- overall supervision and advice on ways to correct deficiencies and streamline business processes;
- advising the Customer on the adaptation and running of marketing campaigns in Belarus;
- other services as agreed by the Parties.
1.3. The above services shall be provided from May 11, 2018 to December 1, 2018.
1.4. The services shall be provided in Belarus at the location of the Customer’s coffee shops. Subject to the agreement of the Parties, the services may be provided in Nicosia, Cyprus.
1.5. The Contractor hereby agrees to transfer to the Customer, and the Customer hereby agrees to accept from the Contractor, the right to use the Contractor’s C... trademark, Madrid System registration number ... (http://www.wipo.int). The amount of compensation payable by the Customer to the Contractor for the right to use the C... trademark is set forth below.
1.6. The Customer may use the aforementioned trademark in full, in any form and in any manner not contrary to the law, including for product (work, service) customization purposes.
1.7. The right to use the Contractor’s C... trademark is granted to the Customer for the period from May 11, 2018 to December 1, 2018.
2. RIGHTS AND RESPONSIBILITIES OF CONTRACTOR
2.1. The Contractor shall perform the services hereunder in a proper manner and within the deadlines set forth herein, transmitting the deliverables to the Customer via electronic communication channels.
2.2. The Contractor shall, without delay, notify the Customer and, pending the receipt of instructions therefrom, suspend the provision of services upon detection of the following:
2.2.1. any adverse, for the Customer and (or) the Contractor, consequences of the implementation of his instructions regarding the method of service provision;
2.2.2. other circumstances beyond the Contractor's control that impede the provision of a service or render its timely completion impossible;
2.2.3. refrain from disclosing confidential information of the Customer;
2.3. The Contractor shall, upon request from the Customer, cure all identified defects.
2.4. The Contractor may refuse to perform his obligations hereunder, subject to the full reimbursement of damages, including actual damage and lost profits, incurred by the Customer.
3. RIGHTS AND RESPONSIBILITIES OF CUSTOMER
3.1. The Customer shall accept and pay for the services rendered in the amount and within the deadlines set forth herein.
3.2. The Customer shall, without delay, notify the Contractor in writing about any identified defects, including the need for additional services.
3.3. The Customer may monitor the process of service provision, including by visual inspection of the facilities retail space.
3.4. The Customer has the right to:
3.4.1. monitor the quality of services rendered by the Contractor;
3.4.2. terminate this Agreement and demand compensation for damages if the Contractor fails to fulfill his obligations hereunder in a timely manner or performs a service so slowly that its timely completion becomes clearly impossible;
3.4.3. terminate this Agreement at any time prior to the acceptance of the deliverables, subject to the payment to the Contractor of the prorated amount for the services actually rendered prior to such termination.
4. PROVISION OF SERVICES
4.1. All services hereunder shall be provided at the request of the Customer in accordance with the terms and conditions of this Agreement.
4.2. The Parties agree that the list of the services to be provided hereunder is not exhaustive and may be adjusted by agreement of the Parties.
4.3. The Parties shall certify the provision of services by executing a Certificate of Services Rendered, which also constitutes proof of the services rendered hereunder.
4.4. The Parties shall execute a Certificate of Services Rendered on or before the expiration date of this Agreement, specifying the services rendered hereunder.
At the same time, the Parties may execute Certificates of Services Rendered for other periods (timeframes, phases) of service provision agreed by them occurring within the term of this Agreement.
5. COST OF SERVICES AND TERMS OF PAYMENT
5.1. All payments between the Customer and the Contractor shall be made by wire transfer in US dollars.
5.2. The Customer shall pay for the services rendered hereunder in full and within the deadlines set forth herein, but no later than 10 business days from the date of execution of the Certificate of Rendered Services.
5.3. The total and final cost of the services is USD__________.
5.4. In the event of complete or partial non-fulfillment by the Contractor of his obligations hereunder occurring for whatever reason, he shall refund the Customer the amount paid less the cost of services actually rendered. Such refund shall be made within 30 calendar days from the date of submission of a request therefor by the Customer.
5.7. When services are paid for in advance, the date of provision of services shall not exceed 60 calendar days from the date of receipt of the advance payment.
5.8. The amount of compensation payable for the use of the C... trademark in the period set forth in par.1.7. hereof is USD____________ .
5.9. The compensation for the use of the C... trademark shall be transferred to the Contractor within 10 business days from the date of signing by the Parties of the Certificate of Rendered Services.
6. DISPUTE RESOLUTION
6.1. Any disputes or differences arising between the Parties out of or in connection herewith shall be, whenever possible, settled through negotiations.
6.2. If the Parties cannot reach an agreement, the dispute shall be settled in a court local to the plaintiff.
7. CONTRACT TERM
7.1. This Agreement shall enter into force on the date of its signature by the Parties and shall remain valid until December 1, 2018 inclusive, but, in any case, until the complete fulfillment by the Parties of their obligations hereunder.
7.2. The term of this Agreement may change subject to the occurrence of circumstances beyond the Parties' control.
7.3. Either Party may terminate this Agreement prematurely upon written consent of the other Party. The Party wishing to terminate this Agreement shall notify the other Party of its intention to do so at least twenty (20) days in advance.
8. LIABILITY OF THE PARTIES
8.1. The Parties shall be liable for non-performance of their obligations hereunder in accordance with the laws of the Republic of Belarus currently in effect.
8.2. In the event of failure by the Contractor to meet the deadline for the provision of services hereunder, the Customer may charge the Contractor a penalty equal to 0.1% of the total value outstanding services. Payment of penalties shall not relieve the Contractor of its obligations hereunder.
8.3. In the event of failure by the Customer to meet the deadline for making payments hereunder, the Contractor may charge the Customer a penalty equal to 0.1% of the total outstanding amount. Payment of penalties shall not relieve the Customer of its obligations hereunder.
The Parties hereby agree that the assessment and charging of penalties is subject to the observance of the pre-arbitration dispute resolution procedure.
9. FORCE MAJEURE
9.1. The Parties shall be relieved from liability for any partial or complete non-fulfillment of their obligations hereunder if such non-fulfillment is caused by force majeure occurring after the signing of this Contract which could not be foreseen or prevented by the Parties, such as earthquakes, fires, floods and other natural disasters, epidemics, accidents, explosions, military hostilities, and changes in legislation that made it impossible for the Parties to fulfill their obligations hereunder. This list is non-exhaustive.
10. MISCELLANEOUS
10.1. The Parties agree to refrain from disclosing the confidential information they have become aware of in the course of performance of this Agreement. The fact of conclusion of this Agreement alone, as well as its subject matter, is confidential.
10.2. All notices, documents and other correspondence between the Parties related to this Agreement shall be transmitted via electronic communication channels or email (from domain addresses: ___________________________) agreed upon by the Parties separately and/or specified in the section "Bank Details and Signatures of the Parties." In this case, the documents transmitted in the above manner shall be deemed valid and binding until the submission of the originals.
10.2. Any amendments or supplements to this Agreement shall be valid when made in writing and signed by the authorized representatives of both Parties.
10.3. This Agreement is made out in the Russian and English languages. In the event of a conflict between the Russian and English versions, the English version shall prevail.

Вопросы борьбы с коррупцией и финансовыми преступлениями, осуществляемыми с использованием новых технологий, обсуждаются на семинаре, организованном Департаментом финансовых расследований Комитета госконтроля, Организацией по безопасности и сотрудничеству в Европе (ОБСЕ) и управлением по наркотикам и преступности Организации Объединенных Наций (УНП ООН). Мероприятие проходит 26 ноября 2018 г. в Минске.
В качестве приглашенных экспертов в семинаре принимают участие представители Бюро координатора экономической и экологической деятельности ОБСЕ Андрей Мунтян и УНП ООН Алексей Фещенко.
Республику Беларусь в мероприятии представляют работники Департамента финансового мониторинга и органов финансовых расследований Комитета госконтроля во главе с заместителем Председателя Комитета госконтроля – директором ДФР Игорем Маршаловым.
Необходимо отметить, что проблема использования новых платежных технологий и виртуальных валют сегодня актуальна для всего мира в целом.
В этой связи с участием представителей ОБСЕ и УНП ООН в рамках семинара предполагается обсуждение новых платежных технологий, крипто-валютных рисков, методов и форм отслеживания движения виртуальных валют, способов противодействия и документирования преступной деятельности с использованием теневого Интернета (DarkNet, DeepWeb), а также основных тенденций развития финансового мониторинга в блокчейн сетях.
Интерес органов финансовых расследований к данной теме не случаен, поскольку развитие в Республики Беларусь инновационной сферы, а также взятый курс на развитие информационных технологий и построение современной цифровой экономики также влечет за собой и определенные риски трансформации финансовых преступлений. При этом наиболее актуальным в данном контексте видится возможное использование при совершении финансовых преступлений новых платежных технологий, виртуальных валют, а также более активное применение возможностей теневого Интернета.

Состоялся Совместный семинар ЕАГ И АТГ
3 - 5 декабря 2018 г. в г. Новосибирске (Российская Федерация) состоялся совместный типологический семинар Евразийской группы по противодействию легализации преступных доходов и финансированию терроризма (ЕАГ) и Азиатско-Тихоокеанской группы по борьбе с отмыванием денег (АТГ).
На открытии мероприятия со словами приветствия выступили Полномочный представитель Президента Российской Федерации в Сибирском федеральном округе Сергей Иванович Меняйло, Исполнительный секретарь ЕАГ Владимир Павлович Нечаев и Директор по типологиям Секретариата АТГ Дэвид Беккер.
По словам Полномочного представителя Президента Российской Федерации в Сибирском федеральном округе уже более 10 лет эффективно действует межведомственная рабочая группа по противодействию незаконным финансовым операциям. Реализация в России Рекомендаций ФАТФ позволила вдвое сократить объем совершаемых сомнительных финансовых операций в округе. Также С.И. Меняйло отметил, что справиться с современными вызовами и угрозами можно только путем объединения усилий всего мирового сообщества.
С.И. Меняйло: «Мы все понимаем, что для принятия эффективных мер по противодействию международным террористическим организациям, трансграничной и транснациональной преступности нам необходимо постоянно совершенствовать механизмы взаимодействия подразделений финансовой разведки, правоохранительных, надзорных структур, организаций частного сектора на международном уровне».
Дэвид Беккер: «ЕАГ является одним из самых близких партнеров Азиатско-Тихоокеанской группы среди всех региональных групп по типу ФАТФ. Это уже второй семинар по типологиям, который мы проводим совместно с Евразийской группой, первый был в Монголии в 2013 году, кроме того состоялся совместный семинар для экспертов-оценщиков. В 2018 году на семинаре присутствуют более 20 неправительственных организаций и организаций частного сектора. С точки зрения АТГ партнерство с частным сектором является значимым фактором успешной работы».
В.П. Нечаев: «Мы собрались, чтобы рассмотреть важные темы в нашей работе по вскрытию механизмов, используемых преступниками для отмывания денег и финансирования терроризма. Две из этих тем – финансирование терроризма за счет доходов, полученных преступным путем, и риски, связанные с виртуальными активами, соответствуют текущим приоритетным направлениям деятельности ФАТФ. Некоторое время назад ЕАГ исследовало тему покупки билетов для иностранных боевиков-террористов. Должен сказать, что мы вместе с Антитеррористическим центром СНГ получили неожиданную отдачу – заинтересованность со стороны ИКАО (Международная организация гражданской авиации – ред.)».
На форуме обсуждались вопросы в рамках трех тематических секций: финансирование терроризма за счет доходов, полученных преступным путем, в том числе доходов от организованной преступной деятельности; торговля и контрабанда людьми; риски, связанные с цифровыми финансовыми активами.
В ходе первой секции участники ознакомились с деятельностью ФАТФ по оценке рисков финансирования терроризма, рассмотрели доклады стран о национальной оценке рисков в этой сфере, региональную оценку рисков АТГ, работу ООН по связям финансирования терроризма и организованной преступности, а также соответствующие резолюции СБ ООН. Участникам были представлены финансовые расследования по финансированию терроризма за счет доходов, полученных преступным путем, доходов от организованной преступной деятельности в рамках текущего совместного исследования стран ЕАГ и АТГ по одноименной тематике, итоги которого будут подведены во второй половине 2019 года.
На секции, посвященной рискам виртуальных активов, были рассмотрены доклады стран со случаями использования виртуальных активов в целях отмывания денег, а также практика национальных компетентных органов по выявлению и расследования таких преступлений, обеспечительным мерам и конфискации. Обсуждались роль частного сектора в выявлении и анализе соответствующих схем, включая механизмы выявления незарегистрированных провайдеров услуг виртуальных активов, возможности получения от традиционного банковского сектора информации об операциях с использованием криптовалюты и применение специализированных технических средств. Представитель Секретариата ФАТФ отметил, что этот семинар является существенным вкладом ЕАГ и АТГ в текущий проект ФАТФ по созданию операционного руководства по выявлению, расследованию, аресту и конфискации виртуальных активов.
Секция по борьбе с торговлей и контрабандой людьми проходила при активном участии представителей гражданского общества и частного сектора, которые ознакомили участников с кейсами, направленными на выявление финансовых транзакций, связанных с этими преступлениями.
В мероприятии приняли участие свыше 260 представителей подразделений финансовой разведки, правоохранительных и надзорных органов, частного сектора из более 60 стран и организаций Евразийского и Азиатско-Тихоокеанского регионов.
В завершение семинара состоялась презентация проектов МУМЦФМ для участников международной системы ПОД/ФТ.
В заключительном слове по итогам мероприятия руководитель МРУ Росфинмониторинга по СФО А.А. Долбня отметил, что для Российской Федерации обсуждение тем, поднятых на семинаре, особенно важно в контексте предстоящей взаимной оценки по линии ФАТФ.
А.А. Долбня: «Многие страны – участницы семинара уже принимали у себя выездные миссии и смогли оценить высокую планку, которая установлена ФАТФ для национальных систем ПОД/ФТ. Уверен, что рассмотренные на секциях типологии найдут практическое применение в работе национальных антиотмывочных систем. Это приведет к минимизации рисков использования цифровых финансовых активов в преступных целях, а также к повышению эффективности противодействия финансированию терроризма и борьбы с торговлей людьми».

Обучающий семинар для представителей кредитных организаций в целях выявления и предотвращения случаев легализации доходов, полученных преступным путем , финансирования терроризма и финансирования распространения оружия массового поражения
27 ноября 2018г. в Национальном банке Таджикистана был организован обучающий семинар в области противодействия легализации доходов полученных преступным путём, финансированию терроризма и финансированию распространения оружия массового поражения (ПОД/ФТ/ФРОМП) для представителей кредитных организаций Республики Таджикистан.
Борьба с терроризмом и экстремизмом требует доверия, взаимного уважения и объединения всех стран перед этой общей опасностью. Целью проведения данной встречи является защита безопасности страны и устранения таких негативных последствий, как легализация (отмывание) доходов, полученных преступным путем и финансирование терроризма.
Необходимо отметить, что данный семинар является уже 3-им по счету обучающим мероприятием, проводимом Департаментом финансового мониторинга при Национальном банке Таджикистана по инициативе Ассоциация микрофинансовых организации Таджикистана (АМФОТ).
Открытие семинара состоялось с приветственным словом Директора Департамента финансового мониторинга при Национальном банке Таджикистана, который отметил, что при проведении проверок в кредитных организациях были выявлены ряд недостатков в работе специалистов Комплаенс. В этой связи, организация такого рода мероприятий окажет существенное воздействие на повышение уровня осведомленности об исполнении требований национального законодательства в сфере ПОД/ФТ/ФРОМП.
Сотрудниками Департамента финансового мониторинга при Национальном банке Таджикистана были представлены презентации на следующие темы:
• Требования законодательства Республики Таджикистан в сфере ПОД/ФТ/ФРОМП и внесение изменений в них;
• Международные стандарты в сфере ПОД/ФТ/ФРОМП;
• Взаимодействие Департамента финансового мониторинга при Национальном банке Таджикистана с правоохранительными органами в сфере предотвращения случаев финансирования терроризма;
Необходимо отметить, что представители Департамента управления международными резервами и политики валютного курса в данном семинаре активно выступили на тему «Затруднение и ошибки в операциях, связанных с иностранными валютами».
В этой встрече со стороны участников наблюдался повышенный интерес, связанный с деятельностью кредитных организации в этой сфере, возникли многочисленные вопросы. Директор Департамента Файзуллозода Ф. представил соответствующие ответы на вопросы участников семинара и отметил, что при возникновении любых вопросов они могут обращаться в Департамент с просьбой оказать содействие.
Более 60 представителей кредитных организаций страны участвовали в данном семинаре. Необходимо отметить, что проведение подобных встреч является результатом тесного сотрудничества между Департаментом финансового мониторинга и кредитными организациями в рамках соблюдения требований законодательства в сфере ПОД/ФТ/ФРОМП.

The MENAFATF holds its 28th Plenary Meeting in Beirut
The 28th Plenary Meeting of the Middle East and North Africa Financial Action Task Force on Combating Money Laundering and the Financing of Terrorism (MENAFATF) was opened today, Tuesday 27 November 2018, at the Intercontinental Phoenicia Hotel, Beirut, Lebanon, under the presidency of HE Mr. Abdul Hafiz Mansour, the Secretary General of the Lebanese Special Investigation Commission (SIC), and the secretariat of HE Dr. Alwaleed Bin Khalid Alsheikh, the MENAFATF Executive Secretary.
The Meeting is attended by a large number of experts in the field of combating Money-laundering and the financing of terrorism from the Member States and the observers.
In the three days prior to the plenary meeting, the MENAFATF held the meetings of the Mutual Evaluation Working Group (MEWG), the Technical Assistance and Typologies Working Group (TATWG), the Financial Information Units Forum, the Operational Experts Forum on combating Terrorists Financing, and the National Risk Assessment Committee.
The plenary meeting will address, throughout two days, many topics on its agenda, the most important of which are the discussion of the Assessment Report of the Kingdom of Morocco which assess its compliance with the International standards on Combating Money-Laundering and the Financing of Terrorism and Proliferation, and the follow-up report of the Republic of Tunisia, in addition to a number of follow-up reports of some member states.
The meeting will also address the relationship with international bodies and organizations working in the field of money-laundering and the financing of terrorism, the existing and future cooperation with them, such as the Financial Action Task Force (FATF), the Counter-Terrorism Executive Committee of the United Nations Security Council, and other counterpart entities, in addition to considering the strategic plan for the years 2019 – 2021, the work Plan for the year 2019, and some working papers on plans, funding and other organizational and administrative matters. Moreover, the meeting will consider some applications for observer status.
This meeting is part of the consolidation of regional and international efforts to combat money-laundering and related predicate offences and financing of terrorism in order to protect economic, social and political systems from the threats of such crimes.
The Anti-Cybercrime Forum will also be held by the Lebanese Special Investigation Commission for the fourth consecutive year, which is held this year in cooperation with the MENAFATF on Thursday, 29 November 2018.

The Committee of Experts on the Evaluation of Anti-Money Laundering Measures and the Financing of Terrorism (MONEYVAL) held its 57th Plenary meeting in Strasbourg from 3 to 7 December 2018.
Amongst the highlights of the Plenary, MONEYVAL held a panel discussion on countering the laundering of proceeds from human trafficking and modern slavery, with representatives of the FATF, the Egmont Group, GRETA and the private sector. Moreover, it adopted a regional operational plan to counter terrorism financing. MONEYVAL completed the country assessments of the Czech Republic and Lithuania, adopted the joint FATF - MONEYVAL assessment of Israel, and adopted follow-up reports of the following countries: Andorra, Azerbaijan, Croatia, Hungary, Liechtenstein, Montenegro, Romania, Serbia, Slovenia and “The former Yugoslav Republic of Macedonia”. The Committee also adopted a report on the voluntary tax compliance scheme of the Republic of Moldova.
The Committee heard various presentations and held discussions on topics such as: recent changes to the FATF standards with regard to the regulation of virtual assets; a presentation of a case by the State Financial Monitoring Service of Ukraine which was awarded the Best Egmont Case Award 2018; terrorist financing disruption strategies; a horizontal review of the sector of designated non-financial businesses and professions (supervision and implementation of preventive measures) in the new round of evaluations; the International Training and Methodology Centre for Financial Monitoring of the Russian Federation; and an introduction to various intelligence and educational tools of the Basel Institute on Governance to counter corruption and financial crimes. The Committee also held an exchange of views with Mr Branislav Bohacik, President of the Conference of the Parties to the Council of Europe Convention on Laundering, Search, Seizure and Confiscation of the Proceeds of Crime and on the Financing of Terrorism.

Participants in the workshop, organized by the State Control Committee's Financial Investigations Department, the Organization for Security and Cooperation in Europe (OSCE) and the United Nations Office on Drugs and Crime (UNODC), are discussing the fight against corruption and financial crimes committed using new technology. The meeting is being held on the 26 November 2018 in Minsk.
Representatives of the Office of the Co-ordinator of OSCE Economic and Environmental Activities Andrei Muntyan and UNODC Alexey Feschenko are participating in the workshop as invited experts.
Belarus is represented at the workshop by the employees of the State Control Committee's Financial Monitoring Department and Financial Investigations Department, headed by Deputy Chairman of the State Control Committee – FID Director Igor Marshalov.
It should be noted that the problem linked to the use of new payment technology and virtual currencies remains relevant throughout the world.
In this regard, with input from the representatives of the OSCE and UNODC attending the workshop, participants are expected to discuss new payment technologies, cryptocurrency risks, methods and approaches used for tracking the movement of virtual currencies, ways to combat and document criminal activity carried out through shadow online platforms such as DarkNet and DeepWeb, and the key trends in the development of financial monitoring in blockchain networks.
The interest in this topic displayed by financial investigation bodies is not accidental, since the fostering of an innovative environment in Belarus and the country's course towards the development of information technology and building a modern digital economy also entail certain risks of financial crime transformation. In this context, the possible use of new technology and virtual currencies to commit financial crimes, coupled with a more aggressive use of DarkNet, seems particularly likely.

EAG/APG Workshop
The Eurasian Group on Combating Money Laundering and Financing of Terrorism (EAG)/Asia-Pacific Group on Money Laundering (APG) joint workshop was held in Novosibirsk (Russia) on December 3-5, 2018.
The workshop opened with welcoming remarks from Sergey I. Menyaylo, plenipotentiary representative of the Russian president in the Siberian Federal District; Vladimir P. Nechaev, EAG executive secretary; and David Becker, director for typologies at the APG Secretariat.
According to Menyaylo, it has been more than 10 years since the establishment of the Interagency Working Group on Combating Illegal Financial Transactions. The implementation by Russia of the FATF Recommendations has led to a 50 percent decline in the number of suspicious transactions carried out in the district. Only by combing the efforts of the entire international community can we overcome modern challenges and threats, stressed Menyaylo.
S I. Menyaylo: "We all understand that in order to be effective in combating international terrorism and cross-border and transnational crime, we should constantly improve international cooperation between financial intelligence units, law enforcement, supervisors and the private sector."
David Becker: "The EAG is one of the Asia-Pacific Group's closest partners among all FATF-style regional bodies. This is already a second typologies workshop we have held jointly with the Eurasian Group, the first was in Mongolia in 2013, which was preceded by a joint assessors' workshop. The 2018 workshop was attended by representatives of more than 20 NPOs and organizations from the private sector. From the APG's view point, partnership with the private sector is key to our success."
V P. Nechaev: "We've gathered here today to consider the issues that are key to our efforts to disrupt money laundering or terrorist financing schemes used by criminals. Two of these issues – the use of criminal proceeds to finance terrorists and the risks associated with virtual assets – are listed among the FATF's current priorities. Some time ago, the EAG researched the issue connected with the purchase of tickets for foreign terrorist fighters. I must say that for us and the CIS Anti-Terrorist Centre, one of the surprise outcomes of this work was the interest shown by the ICAO [International Civil Aviation Organization]."
The issues discussed at the forum were structured into three thematic sections: the use of criminal proceeds, including from organized crime, to finance terrorists; human trafficking; and the risks associated with digital financial assets.
During the first section, participants familiarized themselves with the FATF's assessment of terrorist financing risks; reviewed countries' reports on the national assessment of risks in this area; and studied the findings of the APG's regional risk assessment, the UN's research into the potential links between terrorist financing and organized crime, and the relevant UNSC resolutions. The meeting included presentations of financial investigations into the use of criminal proceeds – including from organized crime – to finance terrorists, conducted within the framework of the EAG/APG joint study on the same topic, whose findings will be presented in the second half of 2019.
Participants in the section on risks related to virtual assets, meanwhile, reviewed countries' reports on the use of virtual assets for money laundering, studied the experience of national competent authorities in identifying and investigating such crimes, and talked about the use of enforcement measures and confiscations. They also discussed the role of the private sector in identifying and analysing the relevant schemes, including the mechanisms for identifying unregistered providers of virtual asset services, the possibility of obtaining information on cryptocurrency transactions from the traditional banking sector and the use of specialized hardware. According to a representative from the FATF Secretariat, this workshop represents a significant contribution by the EAG and APG to the current FATF project to draft operational guidelines on the identification, investigation, seizure and confiscation of virtual assets.
The anti-trafficking and smuggling section took place with active participation of representatives from civil society and the private sector, who familiarized the participants with the initiatives aimed at identifying financial transactions related to these crimes.
The meeting was attended by over 260 representatives of financial intelligence units, law enforcement and supervisory agencies and the private sector from more than 60 countries and organizations of the Eurasian and Asia-Pacific regions.
The workshop ended with the presentation of ITMCFM projects for the international AML/CFT system participants.
In his closing remarks, the head of Rosfinmonitoring's Siberian Federal District office, A A. Dolbnya, noted that the discussion of the topics raised at the workshop is particularly important for the Russian Federation in the context of the upcoming FATF mutual evaluation.
A A. Dolbnya: "Many countries participating in the workshop have already hosted visiting missions and appreciated the high bar set by the FATF for national AML/CFT systems. I'm confident that typologies discussed in the sections will find practical application within the national AML/CFT systems, helping mitigate the risks stemming from the use of digital financial assets for criminal purposes and bolstering the fight against terrorist financing and human trafficking."

A training workshop for representatives of credit institutions on the detection and disruption of money laundering, terrorist financing and proliferation financing
A training workshop on anti-money laundering and countering the financing of terrorism and proliferation (AML/CFT/PF) for representatives of Tajikistan's credit institutions was held on 27 November 2018 at Tajikistan's National Bank.
A successful fight against terrorism and extremism is not possible without trust, mutual respect and consolidation of efforts by all countries in the face of a common threat. The Founder of Peace and National Unity - Leader of the Nation, the President of the Republic of Tajikistan, esteemed Emomali Rakhmon, speaking from the lofty tribunes of the UN and other international organizations, emphasized that terrorism has no homeland, nation or religion.
The purpose of the meeting was to safeguard national security and combat money laundering and terrorist financing.
Notably, this was already a third training workshop conducted by the Financial Monitoring Department of Tajikistan's National Bank on the initiative of the Association of Microfinance Organizations of Tajikistan (AMFOT).
In his opening remarks to the workshop participants, the director of the Financial Monitoring Department of Tajikistan's National Bank pointed out at some shortcomings identified by auditors in the work of credit institutions' compliance officers. In this regard, the organization of such events will go a long way towards improving compliance with national AML/CFT/PF requirements.
Personnel of the Financial Monitoring Department of Tajikistan's National Bank delivered presentations on the following topics:
• Tajikistan's AML/CFT/PF regulations and amendments thereto;
• International AML/CFT/PF standards;
• Cooperation between the Financial Monitoring Department of Tajikistan's National Bank and law enforcement in preventing terrorist financing.
Particularly notable to the workshop participants was a presentation by representatives of the Department of International Reserves Management and Exchange Rate Policy on "Difficulties and Errors in Foreign Currency Transactions".
Intense interest among the workshop participants was aroused by the work carried out by credit institutions in this area, who also asked many questions. F. Fayzullozoda, the director of the Financial Monitoring Department, responding to the participants' questions, urged them to reach out to the FMD for assistance in any matters.
More than 60 representatives of the country's credit institutions participated in this workshop. It should be noted that decisions to hold such meetings were the outcomes of close cooperation between the Financial Monitoring Department and credit institutions in ensuring compliance with AML/CFT/PF requirements.

ООО «...», именуемое в дальнейшем «Покупатель», в лице Исполняющего обязанности Генерального директора ...., действующего на основании Устава, с одной стороны, и ООО ..., являющееся юридическим лицом по законодательству Российской Федерации, расположенным по адресу: 105066, Россия, г. Москва, ..., в лице Генерального директора ..., действующего на основании Устава, (далее – "Поставщик") согласовали следующие условия поставки Товара в Спецификации № 14 (далее – «Спецификация») к Договору поставки №21062016 от «21» июня 2016 года (далее – «Договор»):
1. Итого общая стоимость Товара по настоящей Спецификации составляет 3 028 542 рубля (три миллиона двадцать восемь тысяч пятьсот сорок два рубля 37 копеек) без учета НДС, который оплачивается дополнительно в соответствии с требованиями действующего российского законодательства.
2. Оплата Товара производится Покупателем в течении 60(шестидесяти) календарных дней с момента подписания отгрузочных документов Покупателем при наличии счета поставщика.
3. Поставка Товара осуществляется не позднее 28 ноября 2018 года.
4. Покупатель вправе предъявить требования в отношении недостатков товара в течение гарантийного срока. Стороны договорились, что гарантийный срок составляет 1 (один) год. Гарантийный срок исчисляется с даты перехода права собственности на Товар Покупателю. Датой передачи товара Покупателю является дата подписания товарной накладной.
5. Товар с заводскими дефектами подлежит обмену/возврату следующими способами:

-В случае обнаружения заводского дефекта и территориальной удаленности АСЦ от конечного потребителя, Покупатель доставляет неисправный товар на свой склад по адресу: 142434, Российская Федерация, Московская область,.... После получения неисправного товара Покупатель направляет Поставщику по электронной почте по адресу ... уведомление о возникновении таких недостатков с просьбой направить представителя Поставщика для оформления Акта о выявленных недостатках. В случае, если в течение 7 (семь) календарных дней с момента направления Покупателем уведомления уполномоченный представитель Поставщика не явится для оформления Акта о недостатках, Акт составляется в одностороннем порядке Покупателем и имеет юридическую силу.
В Акте должна содержаться следующая информация:
(а) Наименование Товара, количество Товара, номер и дата накладной ТОРГ-12 или документа его заменяющего;
(б) Дата передачи товара третьим лицам (если применимо);
(в) Подробное описание недостатков Товара;
6. 10 (десятого) и 25 (двадцать пятого) числа каждого месяца Покупатель направляет Поставщику по электронной почте по адресу ... Заявку на забор бракованного товара со следующего электронного адреса Заказчика:
В случае, если указанные выше числа выпадают на выходной или праздничный день, дата подачи Заявки переносится на рабочий день, предшествующий указанной дате. Поставщик обязуется за свой счет вывезти указанный в заявке неисправный товар для диагностики и ремонта в АСЦ один раз в месяц в течение первой недели в будние дни в период с 9-00 по 18-00, при условии действующего гарантийного срока.
7. Диагностика и ремонт товара в АСЦ, а также доставка отремонтированного товара на Склад Покупателя производится в течение 25 (двадцати пяти) рабочих дней с момента забора товара у Покупателя по товарной накладной на возврат Товара и за счет Поставщика.
8. Если Товар не подлежит ремонту, Поставщик оформляет Акт о неремонтопригодности Товара и предоставляет один экземпляр Акта Покупателю в срок не позднее чем в течение 21 (двадцати одного) дня после забора товара со склада Покупателя.
9. Если дефектный Товар подпадает под гарантийные условия, но не подлежит ремонту, Поставщик обязуется по выбору Покупателя в течение 15 (пятнадцать) рабочих дней после составления Акта о неремонтопригодности заменить товар с дефектами, либо в случае изменения модельного ряда, заменить модель с дефектами на аналогичную, либо вернуть уплаченную стоимость возвращаемого товара при предоставлении покупателем Товарной накладной и счет-фактуры на возврат.
10. В случае обнаружения АСЦ на товаре повреждений, не попадающих под гарантию (например, следы вскрытия, следы от ударов и падений, следы попадания влаги) Поставщик возвращает неисправный товар Покупателю на склад по адресу:142434, Российская Федерация, Московская область..., с приложением документов, подтверждающих не гарантийные повреждения такого товара.
11. В случае если вся партия возвращенного Товара, отгруженная в одном транспортном средстве, не подпадает под гарантийные условия, на основании документов, подтверждающих не гарантийные повреждения такого Товара Покупатель оплачивает транспортные расходы Поставщика.
12. Настоящее Приложение (Спецификация) является неотъемлемой частью Договора поставки №21062016 от 21» июня 2016 года составлено в двух экземплярах, по одному экземпляру для каждой из Сторон. Оба экземпляра имеют равную юридическую силу.

4. Defects claims filed within the warranty period will only be accepted. The parties hereby agree that the warranty period shall be one (1) year, commencing from the date of transfer of title to the Goods to the Buyer. The date of handover of the Goods to the Buyer shall be the date of signing of the consignment note.
5. The goods with manufacturing defects can be exchanged/returned as follows:
- personally by the end user to the manufacturer's authorized service center (hereinafter "ASC"). A complete list of ASCs, their addresses and business hours is accessible at: http:...
- In the event of discovery of a manufacturing defect, and subject to the end user's remoteness from the nearest ASC, the Buyer shall deliver the defective goods to its warehouse at: 142434, Russia, Moscow Region.... After the delivery of defective goods, Buyer shall notify the Suppler of the discovery of such defects by an email notification sent to ... and request the participation of the Supplier's representative in the drawing up of a Defects Certificate. If, within seven (7) calendar days from the date of dispatch of a notification by the Buyer, an authorized representative of the Supplier fails to arrive for the drawing up of the Defects Certificate, such Defects Certificate shall be drawn up by the Buyer unilaterally and be binding on the Supplier.
The Defects Certificate shall contain the following information:
(a) The name and quantity of the Goods, the reference number and date of the consignment note TORG-12 or the document replacing it;
(b) Date of handover of the Goods to third parties (if applicable);
(c) A detailed description of the defects in the Goods;
6. The Buyer shall, on the tenth (10th) and twenty fifth (25th) day of each month, send to the Supplier's e-mail address at ... a Request to collect the defective goods from the following email address of the Customer:
Should the above dates fall on a weekend or public holiday, the filing date of the Request shall be moved to the business day preceding the specified date. The Supplier shall, at its own expense, transport the defective goods specified in the request to the ASC for diagnostics and repair once a month during the first week on weekdays from 9:00 to 18:00, subject to the validity of the warranty claim.
7. Diagnostics and repair of the defective goods at the ASC, as well as the delivery of the repaired goods to the Buyer's Warehouse, shall be made at the expense of the Supplier within twenty-five (25) business days from the date of collection of the goods from the Buyer, using the consignment note for the return of the Goods.
8. If the Goods are not repairable, the Supplier shall draw up a Certificate of Non-Reparability and provide one copy thereof to the Buyer no later than twenty one (21) days after the date of collection of the goods from the Buyer's warehouse.
9. If the defective Goods meet the terms of the warranty, but cannot be repaired, the Supplier shall, at the Buyer's option, within fifteen (15) business days after the execution of the Certificate of Non-Reparability, replace the defective goods or, in the event of changes in the product line-up, replace them with similar types of goods, or refund the cost of the goods upon presentation by the Buyer of the consignment note and the invoice.
10. Should the ASC personnel discover any damage to the goods not covered by warranty (e.g. signs of tampering, shock or fall damage, or moisture ingress), the Supplier shall return the defective goods to the warehouse at the following address: 142434, Russia, Moscow Region..., subject to the enclosure of documents evidencing damage not eligible for warranty service.
11. If the entire batch of the returned Goods shipped in one vehicle does meet the warranty terms, the Buyer shall reimburse the Supplier for the transportation costs incurred by the latter, subject to the presentation of the documents evidencing damage to the Goods not eligible for warranty service.
12. This Annex (Specification) constitutes an integral part of Supply Contract No. 21062016 of June 21, 2016, is made out in two copies of equal legal force, one for each of the Parties.

5. The Parties hereby agree to waive any and all claims they may have against each other in connection with the performance of Supply Contract No. 05-000006/2206 of June 26, 2017.
6. This Supplementary Agreement shall enter into force upon signature by the Parties.

5. Стороны подтверждаю, что взаимные претензии по исполнинию условий договора поставки № 05-000006/2206 от 26 июня 2017г. друг к другу отсутствуют.

Отчет взаимной оценки представляет собой детальное описание и анализ системы ПОД/ФТ, а также точечные рекомендации для стран с целью дальнейшего укрепления их систем.

Генеральная прокуратура Республики Таджикистан
Что касается ситуации с риском ФТ в Российской Федерации, то практика показывает, что основным объектом для вербовщиков террористических организаций являются трудовые мигранты. В ходе расследования уголовных дел установлено, что граждане Таджикистана, выезжающие за пределы республики, в основном в Российскую Федерацию в поисках работы, в некоторых случаях, в последующем становясь объектами вербовки представителей террористических организаций отправлялись в ближневосточные страны и примыкали к этим организациям. В каждом из этих случаев «новобранцы» для оплаты авиабилетов и других дорожных расходов обеспечиваются финансами со стороны вербовщиков. Как следствие, основные маршруты выезда граждан Таджикистана для участия в вооруженных конфликтах в Ираке и Сирии пролегают через Российскую Федерацию.
Налоговый комитет при Правительстве Республики Таджикистан
Отсутствие оперативного обмена информации между налоговыми службами Республики Таджикистан и Федеральной налоговой службой Российской Федерации увеличивают риск легализации (отмыванию) доходов и избежание налогообложения.

Верховный Суд Республики Таджикистан
В рамках СНГ были подписаны многосторонние Конвенции «О правовой помощи и правовых отношениях по гражданским, семейным и уголовным делам, (Москва, 22 января 1993 года, Кишинев, 7 октября 2002 года, «О передаче осужденных к лишению свободы для дальнейшего отбывания наказания» (6 марта 1998 года).
Согласно двусторонним и многосторонним договорам (конвенциям) о правовой помощи и правовых отношениях по гражданским, семейным и уголовным делам государства регламентируют два вида деятельности:
- обеспечение гражданам договаривающихся сторон и лицам, проживающим на их территориях, а также юридическим лицам прав и средств правовой защиты наравне с собственными гражданами и юридическими лицами;
- развитие сотрудничества между учреждениями юстиции различных стран в целях оказания правовой помощи друг другу, а также другим органам и заинтересованным лицам.
Соответственно с Российской Федерацией взаимная правовая помощь осуществляется в рамках вышеуказанных Конвенций, когда для совершения требуемых процессуальных действий возникает потребность в обращении к суду иностранного государства с просьбой об оказании правовой помощи, которое направляется в форме судебного поручения (вручение судебных повесток, передача исковых заявлений, истребование доказательств, проведение осмотра, судебных экспертиз и т.п.).
За запрашиваемые четыре года, вопрос взаимной правовой помощи по уголовным делам, связанным с отмыванием доходов, полученных преступным путем, финансированию терроризма между судебными органами наших стран не возникал.
Что касается вопроса выдачи лица для привлечения к уголовной ответственности или для исполнения приговора (экстрадиции), то взаимная правовая помощь оказывается в соответствии с частью 2 Конвенции «О правовой помощи и правовых отношениях по гражданским, семейным и уголовным делам, (Москва, 22 января 1993 года. Направление и исполнение требования о выдаче лица для привлечения к уголовной ответственности или для исполнения приговора в соответствии с главой 49 УПК Республики Таджикистан осуществляется Генеральной прокуратурой Республики Таджикистан.

Международное сотрудничество между Генеральной прокуратурой Республики Таджикистан и Генеральной прокуратурой Российской Федерации по взаимной правовой помощи и выдачи лиц, находящихся в международном розыске, осуществляется на основании Конвенции о правовой помощи и правовых отношений по гражданским, семейным и уголовным делам от 22.01.1993 года (г. Минск).

Причиной отказа в выдаче являлось отсутствие в законодательстве Российской Федерации состава преступления, по которому Республикой Таджикистан обвинялось лицо, заявленное к выдаче; приобретение таким лицом гражданства, статуса беженца либо временного убежища.
2. Статистика по ВПП / экстрадиции
Данные и статистика также могут быть включены для подтверждения информации выше, включая:

Генеральная прокуратура Республики Таджикистан
Оказание ВПП безусловно является полезным. Претензии к качеству получаемых ответов на запросы нет. Также отсутствуют случаи приоритизации запросов, т.е. никаким запросам приоритет не дан.
В последние годы качество и сроки исполнения запросов улучшилось.
В ходе оказания ВПП сложности не возникали.
Случаи совместного расследования дел нет. Однако имеются случаи, когда согласно Конвенции разрешено участие следователей при исполнении запросов как Республики Таджикистан, так и Российской Федерации. В целях обеспечения конфиденциальности конкретные примеры не приводятся.
Следует отметить, что приведенные выше статистические данные включают только общую практику оказания ВПП.
Случаи оказания ВПП по делам, связанным с финансированием терроризма и отмыванием денег отсутствуют.

Департамент финансового мониторинга при Национальном банке Таджикистана
ПФР Российской Федерации является основным партнером Департамента финансового мониторинга при Национальном банке Таджикистана (далее Департамент) в области международного сотрудничества по ПОД/ФТ. В частности хотелось бы отметить очень тесное и взаимовыгодное сотрудничество между нашими ПФР результатом которого становились возбуждение большого количества уголовных по финансированию терроризма, как в Республике Таджикистан, так и в Российской Федерации.
Министерства внутренних дел Республики Таджикистан (МВД)
В части международного сотрудничества МВД Республики Таджикистан и МВД Российской Федерации имеется регулярный обмен информации.

Департамент финансового мониторинга при Национальном банке Таджикистана
Опыт международного сотрудничества
Департамент имеет весьма положительный опыт сотрудничества с ПФР Российской Федерацией. Информация, получаемая от российских коллег является весьма качественным и помогает в проведении финансового анализа и нередко становится основой для последующего возбуждений уголовного дела.
ПФР Российской Федерации приоритизирует запросы в случае, если они направлены с заметкой «срочно» или же «весьма срочно».
Хотелось бы отметить, что направленные запросы ПФР Российской Федерации в адрес Департамента являются качественными и охватывают большой спектр видов преступной деятельности. Так можно отметить, что Департамент получал запросы, связанные с финансированием терроризма, преступлениями террористического характера, легализации преступных доходов, а также ряда предикатных преступлений таких как незаконный оборот наркотиков, уклонение от уплаты налогов и мошенничества.
Можно отметить, что сотрудничество между Департаментом и ПФР Российской Федерации весьма укрепилось за последние 2 года, о чём свидетельствует выросший объём направленных и полученных запросов. Однако, выросший объём никак негативно не повлиял на двустороннее сотрудничество и уровень взаимодействия до сих пор находится на качественно высоком уровне.
Департамент не сталкивался с какими либо проблемами в рамках сотрудничества с ПФР Российской Федерации.
Вместе с тем, хотелось бы отметить, что за последние два года в рамках непосредственного сотрудничества Департамента с ПФР Российской Федерации в Республике Таджикистан правоохранительными органами было возбуждено 15 уголовных дел по статье 179.2 (Финансирование преступлений террористического характера).
Государственный комитет национальной безопасности Республики Таджикистан (ГКНБ РТ)
ГКНБ РТ в основном сотрудничает со специальными службами стран СНГ в рамках Минской Конвенции «О правовой помощи и правовых отношениях по гражданским, семейным и уголовным делам».
При расследовании уголовных дел часто возникает необходимость в проведении следственных действий на территории других стран. В связи с этим Следственное Управление ГКНБ РТ в соответствии с требованиями указанной конвенции составляет соответствующие запросы о проведении необходимых следственных действий. Аналогичные запросы поступают в Следственное Управление ГКНБ РТ из других следственных подразделений стран СНГ. Как показывает практика в основном все запросы исполняются сторонами своевременно и качественно. Сотрудничество в сфере оказания правовой помощи находится на должном уровне. Значимых проблем в сфере сотрудничества не имеются.
За последние 4 года в рамках Минской Конвенции «О правовой помощи и правовых отношениях по гражданским, семейным и уголовным делам» в Следственное Управление ГКНБ РТ поступило более 300 запросов, из которых большую часть составляет ФСБ Российской Федерации.
Министерства внутренних дел Республики Таджикистан (МВД)
МВД Российской Федерации предоставляет качественные и своевременные ответы на запросы МВД Республики Таджикистан. В случае направления срочных запросов, МВД Российской Федерации предоставляет ответ в кратчайшие сроки, к примеру, оперативной и иной информации касающихся преступлений ОД/ФТ и других видов преступлений.
Также, прослеживается улучшение качества и своевременности полученных ответов и запросов. Необходимо отметить, что проблем с получением информации от МВД Российской Федерации не возникало. По инициативным запросам информации полученной от МВД Российской Федерации были возбуждены уголовные дела.
Общий документооборот с МВД Российской Федерации с начала 2018 года составляет 91 запрос.

Таможенные органы для оперативного взаимодействия с правоохранительными подразделениями таможенных органов стран СНГ используют защищенный канал РИЛО-Москва, а со Всемирной таможенной организацией канал Сенком (CENCom).

Министерство юстиции Республики Таджикистан
Необходимо отметить, что Министерство юстиции в рамках реализации Конвенций о правовой помощи и правовых отношениях по гражданским, семейным и уголовным делам от 22 января 1993 года и 7 октября 2002 года сотрудничает с Министерствами юстиции государств-участников Содружества Независимых Государств.
Согласно этих Конвенций учреждения юстиции Договаривающихся Сторон оказывают взаимную правовую помощь по гражданским, семейным и уголовным делам в соответствии с положениями настоящих Конвенций.
Правовая помощь оказывается на основании поручений и иных предусмотренных настоящей Конвенцией обращений, направляемых учреждениями юстиции запрашивающей Договаривающейся Стороны учреждениям юстиции запрашиваемой Договаривающейся Стороны.
Кроме того, Министерство юстиции Республики Таджикистан осуществляет сотрудничество в рамках двусторонних соглашений о правовой помощи и правовых отношениях по гражданским, семейным и уголовным делам с другими государствами такими как, Российская Федерация, Китайская Народная Республика, Турецкая Республика, Объединённые Арабские Эмираты, Азербайджанская Республика, Республика Армения, Республика Беларусь, Грузия, Республика Казахстан, Кыргызская Республика, Республика Молдова и Туркменистан.

Налоговый комитет при Правительстве Республики Таджикистан
Взаимоотношения между Налоговым комитет при Правительстве Республики Таджикистан и уполномоченным органом оцениваемой страны - Федеральной налоговой службой Российской Федерации по части контроля выполнения налоговых обязательств субъектов двух стран, строятся на основании следующих международных актов:

Между Налоговым комитетом при Правительстве Республики Таджикистан и Федеральной налоговой службой Российской Федерации на основании международных соглашений вышеуказанных организован регулярный обмен информацией в бумажной форме по части выполнения налоговых обязательств налогоплательщиками обеих стран.

ГУП «Почтаиточик» имеет финансовые взаимоотношения с ФГУП «Почта России», имеются соглашения, взаимовыгодные договора.
В связи с тем, что приемлемая сумма почтового денежного перевода между почтовыми администрациями составляет 2000 $ долларов США, что является показанием низкого уровня риска ОД ФТ. На данный момент не было необходимости отправить запрос о предоставлении информации по организациям входящих в финансовую группу.

Относительно части международного сотрудничества сообщаем, что согласно статье 470 Уголовно-процессуального кодекса Республики Таджикистан при необходимости проведения на территории иностранного государства допроса, осмотра, изъятия, обыска, экспертизы и иных отдельных следственных и судебных действий, предусмотренных настоящим Кодексом, суд, прокурор, следователь, орган дознания поручает их производство соответствующим органам иностранного государства, с которым имеется договор или международное соглашение об оказании взаимной правовой помощи. Поручение о производстве отдельного следственного действия направляется через Генерального прокурора Республики Таджикистан, либо соответственно его заместителей, которые в необходимых случаях обращаются к посредничеству Министерства иностранных дел Республики Таджикистан.

Более того, необходимо подчеркнуть существенную роль Минской и Кишиневской конвенции о правовой помощи и правовых отношениях по гражданским, семейным и уголовным делам, заключенных в рамках СНГ в оказании правовой помощи и исполнении запросов между государствами –участниками СНГ, а также Договор государств-участников Содружества Независимых Государств о противодействии легализации (отмыванию) преступных доходов и финансированию терроризма.

В рамках действующих международных соглашений и решений КСРНС СНГ в целях уменьшения рисков ОД и ФТ Налоговый комитет при Правительстве Республики Таджикистан считает необходимым скорейшее подписание Протокола по обмену информацией в электронном виде между налоговыми органами государств – участников СНГ, что даст возможность:
1. Получение доступа к базовой информации о налогоплательщиках стран СНГ, и получения информации о бенефициарных собственниках юридических лиц;

Департамент финансового мониторинга при Национальном банке Таджикистана
Республика Таджикистан имеет положительный опыт сотрудничества с Российской Федерацией в вопросе замораживания активов лиц, причастных к террористической деятельности.
Так, ПФР Российской Федерации был направлен список из 419 лиц, причастных к террористической деятельности и находящихся в перечне террористов и экстремистов Российской Федерации для принятия решения о замораживания их активов на территории Республики Таджикистан. Ввиду того, что этот список не был направлен по дипломатическим каналам, то включить в Международный список Республики Таджикистан являлось невозможным.
В этой связи в соответствии с пунктом 34 «Порядка о проведении мероприятий по замораживанию и размораживанию финансовых средств или иного имущества физических лиц и организаций, включенных в список лиц, связанных с терроризмом» ДФМ было принято решение о замораживании средств 419 лиц, причастных к террористической деятельности и соответствующее распоряжение было направлено в адрес подотчетных организаций.
Вместе с тем, в согласовании с Комитетом национальной безопасности Республики Таджикистан ДФМ направил список из 1372 лиц, находящихся в Национальном списке Республики Таджикистан в адрес ПФР Российской Федерации для принятия решения о замораживании активов этих лиц на территории Российской Федерации.
Межведомственной комиссии по противодействию финансированию терроризма Российской Федерации было принято решение о замораживании активов 991 лиц из направленного ДФМ списка. В результате были заморожены 240 банковских счетов 163 лиц из перечня Республики Таджикистан.

With respect to the TF risk in Russia, experience shows that terrorist recruiters focus their efforts on migrant workers. According criminal investigation findings, some Tajik nationals traveling overseas, mainly to Russia in search of work, after being targeted by terrorist recruiters, made a journey to the Middle East to join terrorists. In each of these cases, terrorist recruiters provided their recruits with money to pay for air tickets and other travel expenses. Accordantly, the main exit routes used by Tajik nationals traveling abroad to participate in armed conflicts in Iraq and Syria run through the Russian Federation.
The Tax Committee under the Government of the Republic of Tajikistan
Failure to initiate a rapid exchange of information between Tajikistan's and Russia's tax authorities increases the risk of money laundering and tax avoidance.

The Supreme Court of the Republic of Tajikistan
CIS countries signed multilateral conventions on legal assistance and legal relations in civil, family and criminal matters (Moscow, January 22, 1993, Chisinau, October 7, 2002, "On the Transfer of Sentenced Persons to Serve Out their Sentence" ( March 6, 1998).
According to bilateral and multilateral treaties (conventions) on legal assistance and legal relations in civil, family and criminal matters, States regulate two types of activities:
- provision to citizens of the contracting parties and persons residing in their territories, as well as to legal persons, the rights and remedies similar to those of the native inhabitants and legal persons;
- development of cooperation between justice institutions of different countries in providing legal assistance to each other, as well as to other bodies and persons concerned.
Accordantly, cooperation with the Russian Federation in providing mutual legal assistance is carried out within the framework of the above Conventions, when, in order to commence required proceedings, it is necessary to submit to the court of a foreign state a request for legal assistance, which is sent in the form of a court order (serving of court summons, transfer of claims, disclosure of evidence, carrying out of inspection, forensic examinations, etc.).
No mutual legal assistance in criminal matters related to money laundering or terrorist financing was requested by either of our countries in the last four years.
With respect to the extradition of a person for criminal prosecution or serving of a sentence (extradition), mutual legal assistance is provided in accordance with Part 2 of the Convention "On Legal Assistance and Legal Relations in Civil, Family and Criminal Matters," (Moscow, January 22, 1993) Pursuant to chapter 49 of the Code of Criminal Procedure of the Republic of Tajikistan, the submission and execution of the request to extradite a person for criminal prosecution or serving of a sentence is carried out by the General Prosecutor's Office of the Republic of Tajikistan.

International cooperation between the General Prosecutor’s Office of the Republic of Tajikistan and the General Prosecutor’s Office of the Russian Federation on mutual legal assistance and extradition of persons on the international wanted list is carried out on the basis of the Convention on Legal Assistance and Legal Relations in Civil, Family and Criminal Matters of January 22, 1993 (Minsk).
Belows are the statistics of cooperation between the General Prosecutor’s Office of the Republic of Tajikistan and the General Prosecutor’s Office of the Russian Federation for 2015-2018:
Among the reasons for refusals were the absence of the offence for which extradition was sought by Tajikistan from Russia's list of indictable offences; the acquisition by such person of citizenship, refugee status or temporary asylum.

The Russian FIU is the key partner of the Financial Monitoring Department of Tajikistan's National Bank (FMD) in the field of international cooperation on AML/CFT. In particular, a very close, mutually beneficial cooperation between our FIUs, resulted in the launch of a large number of TF investigations both in Tajikistan and the Russian Federation.

International cooperation experience
The experience of the FMD's cooperation with the Russian FIU is very positive. The quality of the information provided by the Russian FIU is very high. It helps in conducting financial analysis and often serves as the basis for the initiation of criminal proceedings.
The Russian FIU prioritizes requests labeled "urgent" or "very urgent".
It should be noted that the requests sent by the Russian FIU to the FMD if of high quality and cover a wide range of criminal conduct. For example, the FMD received requests related to terrorist and terrorist financing offences, money laundering and various predicate offences such as drug trafficking, tax evasion and fraud.
Cooperation between the FMD and the Russian FIU has strengthened greatly over the past 2 years, as evidenced by the increased volume of sent and received requests. That said, the increased volume had no negatively impact on bilateral cooperation, with the quality of cooperation remaining high.
The FMD encountered no problems in its cooperation with the Russian FIU.
Notably, as a result of direct cooperation between the FMD and the Russian FIU, Tajikistan's law enforcement agencies have launched 15 criminal investigations into offences falling under article 179.2 (Terrorist financing) in the past two years.
State Committee for National Security of the Republic of Tajikistan (SCNS)
The SCNS mainly cooperates with CIS security services under the Minsk Convention “On Legal Assistance and Legal Relations in Civil, Family and Criminal Matters”.
When investigating criminal cases, it is often becomes necessary to carry out investigative activities in the territory of other countries. In this case, the SCNS's Investigation Department, in compliance with the requirements of the said convention, draws up appropriate requests for the conduct of the necessary investigative proceedings. Similar requests are received by the SCNS's Investigation Department from the investigative units of other CIS countries. Experience shows that all requests are generally executed by the parties in a timely and efficient manner. Cooperation in providing legal assistance is at the appropriate level, with no major problems recorded .
As part of cooperation conducted within the framework of the Minsk Convention “On Legal Assistance and Legal Relations in Civil, Family and Criminal Matters”, the SCNS's Investigation Department has received more than 300 inquiries in the past 4 years, most of which from Russia's FSB.

Russia's MIA provides high-quality and timely responses to requests from Tajikistan's MIA. When dealing with urgent requests, Russia's MIA responds as soon as possible, particularly in cases of operational and other intelligence related to ML/TF and other types of offences.
The quality and timeliness of response provision is also improving. No problems in obtaining information from Russia's MIA have been recorded. Information provided by Russia's MIA in response to spontaneous requests was used to launch criminal investigations.
A total of 91 requests have been exchanged with Russia's MIA since the start of 2018.

The customs authorities use the RILO-Moscow secure communication channel to exchange operational intelligence with other CIS customs authorities, and CENCom with the World Customs Organization.

The FMD responded to all requests from the Russian FIU. The Russian FIU also provided relevant responses to all requests from the FMD.

The Ministry of Justice, in compliance with the Conventions on Legal Assistance and Legal Relations in Civil, Family and Criminal Matters of January 22, 1993 and October 7, 2002, cooperates with other CIS MOJs.
Under these Conventions, the justice authorities of the Contracting Parties are required to render mutual legal assistance in civil, family and criminal cases in accordance with the provisions of these Conventions.
Legal assistance is provided on the basis of requests and other appeals provided for by this Convention, sent by justice authorities of the requesting Contracting Party to justice authorities of the requested Contracting Party.
In addition, the Ministry of Justice of the Republic of Tajikistan, in compliance with the bilateral agreements on legal assistance and legal relations in civil, family and criminal matters, cooperates with other countries such as Russia, China, Turkey, the United Arab Emirates, Azerbaijan, Armenia, Belarus, Georgia, Kazakhstan, Kyrgyzstan, Moldova and Turkmenistan.
Regarding the confidential information exchange agreements concluded by the Ministry of Justice with foreign supervisory authorities, we would like to inform you that the Ministry of Justice of the Republic of Tajikistan has entered into cooperation agreements with the Ministries of Justice of Russia, Azerbaijan, Iran, Turkey, Belarus, setting out the procedure for maintaining the confidentiality of information exchanged.

Cooperation between the Tax Committee under the Government of the Republic of Tajikistan and the designated authority of the assessed country (Federal Tax Service of the Russian Federation) in monitoring the fulfillment by the tax payers of the two countries of their tax obligations is conducted on the basis of the following international instruments:

Protocols and Resolutions of the CIS Coordination Council of Heads of Tax Services (CIS CCHTS).
The Tax Committee under the Government of the Republic of Tajikistan and the Federal Tax Service of the Russian Federation, in compliance with the said international instruments, regularly share information in hard-copy format on the fulfillment of tax obligations by taxpayers of both countries.
Communication Service under the Government of the Republic of Tajikistan
Pochailitochik is a structural subdivision of the Communication Service under the Government of the Republic of Tajikistan.
Pochaytochik cooperates with the Russian Post, including in financial matters, on the basis of mutually beneficial agreements concluded by the parties.
A typical amount of postal money transfers between postal agencies does not exceed US$2000, meaning that the ML/TF risk is low. To date, there has been no need to request information on entities comprising the financial group.

From 2016 to 2018, the Tax Committee under the Government of the Republic of Tajikistan received 42 requests for information on foreign economic relations, payment methods used in export-import transactions between Tajik and Russian businesses, and the application of the Agreement on the avoidance of double taxation by legal persons of the Russian Federation.
During this period, the Tax Committee sent 6 requests for assistance in obtaining information on foreign economic relations between Tajik and Russian businesses.

With respect to international cooperation, we hereby inform you that, pursuant to article 470 of the Criminal Procedure Code of the Republic of Tajikistan, when it is necessary to conduct an interrogation, inspection, seizure, search, examination or any other separate investigative or judicial proceedings provided for by this Code in a foreign country, the court, the prosecutor, the investigator or the body of inquiry shall rely on the relevant authorities of a foreign state with which it has entered into a contract or international agreement on the provision of mutual legal assistance, to carry out such proceedings A request to carry out separate investigative proceedings shall be sent through the Prosecutor General of the Republic of Tajikistan, or his deputies, respectively, who, if necessary, shall seek the mediation of the Ministry of Foreign Affairs of the Republic of Tajikistan.
Tajikistan has entered into a number of bilateral mutual legal assistance agreements. as well as being a party to multilateral instruments on legal assistance, such as the Agreement between the General Prosecutor's Office of the Republic of Tajikistan and the General Prosecutor's Office of the Russian Federation on legal assistance and cooperation, the Agreement between the Customs Service under the Government of the Republic of Tajikistan and the Federal Customs Service of the Russian Federation on information cooperation to combat money laundering and terrorist financing during the cross-border movement by natural persons of cash and (or) monetary instruments, etc.
A list of other important international instruments includes the Minsk and Chisinau Convention on Legal Assistance and Legal Relations in Civil, Family and Criminal Matters, the CIS agreements on the provision of legal assistance and execution of requests, as well as the CIS Treaty on Combating Money Laundering and Terrorist Financing.

In line with the international agreements and resolutions of the CIS CCHTS currently in effect, with a view to mitigating ML/TF risks, the Tax Committee under the Government of the Republic of Tajikistan considers it necessary to sign a Protocol on the Exchange of Information in Electronic Format as soon as possible between the CIS tax authorities, which will enable countries:
1. To gain access to basic information on CIS taxpayers and beneficial owners of legal persons;
2. To combat and prevent transactions between related persons, the relations between which may influence the conditions and economic outcomes of their activities or the activities of the persons represented by them.
3. T avoid double taxation and combat tax evasion in the two countries.
Targeted financial sanctions What is your experience of cooperation with the country being assessed in designating individuals for supporting terrorist activities and implementing freezing requests pursuant to UNSCR 1373? Financial Monitoring Department, Tajikistan's National Bank
Tajikistan has generated positive experience of cooperating with the Russian Federation in freezing terrorist assets.
Thus, the Russian FIU sent Tajikistan a list of 419 persons involved in terrorist activities and designated by Russia as terrorists and extremists, for a decision on the freezing of their assets in Tajikistan. Since this list was not commutated to Tajikistan through diplomatic channels, it is not possible to add these persons to the country's International List .
In this regard, pursuant to paragraph 34 of the Procedure for Freezing and Unfreezing Funds or Other Assets of Individuals and Entities Designed for Terrorism, the FMD has decided to freeze the funds of 419 persons involved in terrorist activities, communicating its order to the reporting entities.
At the same time, in coordination with Tajikistan's National Security Committee, the FMD has sent a list of 1372 persons from Tajikistan's Domestic List to the Russian FIU for a decision on the freezing of these persons' assets in the Russian Federation.
Russia's Inter-Agency Committee for Combating the Financing of Terrorism decided to freeze the assets of 991 persons from the list sent by the FMD, resulting in the freezing of 240 bank accounts of 163 listed persons.

совместного семинара АТЦ СНГ/ЕАГ/Интерпол при содействии МУМЦФМ по укреплению взаимодействия между подразделениями финансовой разведки и правоохранительными органами в сфере противодействию финансированию терроризма
г. Алматы, Республика Казахстан, 2-4 октября 2018 г.
В рамках реализации Программы сотрудничества государств – участников СНГ в борьбе с терроризмом и иными насильственными проявлениями экстремизма на 2017–2019 годы и в соответствии с решениями 27-го Пленарного заседания Евразийской группы по противодействию легализации преступных доходов и финансированию терроризма (ЕАГ) 2-4 октября 2018 года в г. Алматы (Республика Казахстан) проведен совместный семинар АТЦ СНГ/ЕАГ/Интерпол при содействии МУМЦФМ по укреплению взаимодействия между подразделениями финансовой разведки и правоохранительными органами в сфере противодействия финансированию терроризма.
В работе семинара приняли участие представители:
органов безопасности и специальных служб государств-участников СНГ, а также подразделений финансовой разведки государств-членов ЕАГ, Межгосударственного авиационного комитета, Генерального секретариата МОУП – Интерпол, Управления ООН по наркотикам и преступности, Европола, ОБСЕ, Исполнительного комитета РАТС ШОС.
Участники семинара отметили, что терроризм и экстремизм по-прежнему остаются в числе ключевых угроз для региона ЕАГ и СНГ. В частности:
- вместе с возвращающимися боевиками («возвращенцами») из регионов боевых действий в страны ЕАГ и СНГ экспортируется новая модель террористической и экстремистской активности - «индивидуальный джихад»;
- перемещение членов международных террористических организаций из Сирии и Ирака в новые зоны конфликтов;
- отмечается тенденция формирования «спящих ячеек» из числа «возвращенцев» и радикально настроенных граждан, не сумевших выехать из своих стран для участия в боевых действиях на стороне террористических организаций;
- происходит усиление вербовочной деятельности среди местного населения со стороны пособников терроризма;
- всецело обсуждены текущие недостатки и уязвимости, существующие в практике по контролю приобретения авиабилетов со стороны третьих лиц в отношении террористов и их пособников.
В этой связи требуется не только наращивание усилий, направленных на предотвращение террористических нападений, в том числе путем их раннего выявления, но применение новых методов и приемов сбора и фиксации информации о финансировании террористической деятельности.
Участники семинара, руководствуясь интересами обеспечения национальной безопасности, исходя из понимания важности дальнейшего повышения эффективности взаимодействия между подразделениями финансовой разведки и правоохранительными органами при расследовании преступлений, связанных с финансированием терроризма, предлагают:
продолжить содействовать развитию правового сотрудничества между государствами-участниками ЕАГ и СНГ в области противодействия финансированию терроризма (ПФТ) путём организации учебных курсов/семинаров по вопросам ПФТ;
использовать возможности подразделений финансовых разведок стран ЕАГ и СНГ в работе компетентных органов в рамках спецопераций по розыску лиц, совершивших преступления террористического характера;
продолжить работу по разработке современных методик по выявлению каналов финансирования терроризма и экстремизма, сбору материалов для подготовки доказательственной базы по делам о финансировании терроризма, блокированию и заморозки активов лиц, причастных к террористической деятельности, с последующей конфискацией средств, предназначавшихся на терроризм;
во взаимодействии с органами финансовой разведки и правоохранительными органами, заинтересованными международными организациями и соответствующими авиаперевозчиками, агентами, а также крупными интернет-агрегаторами по продаже авиабилетов, продолжить работу по устранению выявленных уязвимых мест в части приобретения авиабилетов для третьих лиц;
разработать алгоритм работы для последовательного сопоставления списков лиц, приобретающих авиабилеты и лиц вылетающих по данным авиабилетам в целях более эффективного и оперативного расследования дел, связанных с финансированием терроризма.

of the CIS ATC/EAG/Interpol joint Workshop on Strengthening Cooperation between Financial Intelligence Units and Law Enforcement in Combating Terrorist Financing, with assistance from ITMCFM
2-4 October 2018, Almaty, Kazakhstan
The CIS ATC/EAG/Interpol joint Workshop on Strengthening Cooperation between Financial Intelligence Units and Law Enforcement in Combating Terrorist Financing, organized as part of the implementation of the 2017-2019 CIS Cooperation Programme to Combat Terrorism and Other Violent Manifestations of Extremism and in accordance with the resolutions of the 27th Plenary meeting of the Eurasian Group on Combating Money Laundering and Financing of Terrorism (EAG), was held from 2-4 October 2018 in Almaty (Kazakhstan) with assistance from ITMCFM.
Among the workshop participants were:
representatives of the CIS security and intelligence agencies, EAG financial intelligence units, the Interstate Aviation Committee, the General Secretariat of ICPO-Interpol, the UN Office on Drugs and Crime, Europol, OSCE, and the Executive Committee of the RATS SCO.
According to the workshop participants, terrorism and extremism continue to pose a major threat to the EAG and CIS region. In particular:
- along with the fighters returning to the EAG and CIS countries from the conflict zones ("returnees"), terrorists are exporting a new type of terrorist/extremist threat known as "individual jihad";
- the relocation of members of international terrorist organizations from Syria and Iraq to new conflict zones;
- the trend towards the establishment of "sleeping cells" from among the returnees and radicals who had been unable to leave their countries to fight for terrorists;
- the increased intensity of terrorist recruitment among the local population;
- the existing shortcomings and vulnerabilities in exercising control over the purchase of air tickets for terrorists and their accomplices by third persons.
In this regard, it is necessary not only to step up efforts to prevent terrorist attacks, including through their early detection, but also to use new techniques and methods for collecting and recording terrorist financing intelligence.
The workshop participants, acting in the interests of national security and based on their understanding of the importance of further action to improve the effectiveness of cooperation between financial intelligence units and law enforcement in investigating TF crimes, have proposed the following:
to continue to promote the development of legal cooperation between the EAG and CIS countries in combating the financing of terrorism (CFT) by organizing TF trainings/workshops;
to use the resources of the EAG and CIS financial intelligence units in special operations undertaken by the competent authorities to trace individuals who committed terrorist crimes;
to continue the work aimed at developing modern methods for detecting terrorist/extremist financing channels, gathering evidence in support of terrorist financing investigations, and blocking and freezing the assets of persons involved in terrorist activities, with the subsequent confiscation of funds intended for terrorists;

Hi, my name's Sergei. I'm a native Russian speaker based in
Ukraine with over 12 years of experience.
I hold the Cambridge Certificate of Proficiency in English (CPE), Cambridge University's
highest-level qualification – proof of language mastery (Certificate #1880575).
In addition, I hold the Travel
& Tourism diploma from City of Westminster Collage (London) and University of Cambridge Certificate in
Teaching English to Speakers of Other Language (CELTA) (Certificate

I spent over 8 years studying and working in the UK and
