French term

Permis de communiquer

French to English Law/Patents Law (general) Criminal Law case files (France)
Salut!

Any help with this term in UK English would be appreciated. It is one of a number of documents relating to a criminal case (French Law). I think it is something like 'Authorisation to disclose / produce documents' but I'm not sure.

Cour d'Appel de XXXXX
Tribunal judiciaire de XXXXXX

juge d' instruction
N° Parquet : XXX
N° de dos s i er : XXX

Permis de communiquer

Le juge d'instruction, XXXXX XXXXX , autorise Maître XXXX XXXX, porteur du présent, à

Discussion

DB-9 (asker) Feb 19, 2023:
Hi, the text goes on to list the offences that the offender is charged with and the articles of law that these are provided for and punishable under.
ph-b (X) Feb 19, 2023:
communiquer avec Le juge d'instruction autorise Me X... à communiquer (sous... et à la...) avec le nommé..., détenu provisoirement à...

What's communiquer avec un détenu in legal English?
AllegroTrans Feb 19, 2023:
Asker Does the text go on to specify documents? If not, then I would imagine that this simply means "to communicate with"

Authorisation to communicate

As Jennifer says, there is no equivalent term in English
A prisoner on remand in the UK always has the right to be visited by his/her lawyer without any permission of a judge
Peer comment(s):

agree philgoddard : Or permission, of course.

I have never found you to be churlish

The ST is about a French judge giving permission, not a UK prison governor, and the document you cite doesn't refer to any authorisation process for legal rep. visits to persons remanded in custody

neutral AllegroTrans : Your link doesn't work but I'm not sure that this would help as the source is France, not UK

Thank you for pointing out the link doesn't work. I know the source is FR, but the asker wants help with the term in UK English.
neutral Jennifer Levey : The concept of 'disclosure' (or 'discovery') might be relevant if the ST said communiquer au nommé ... - but it actually says communiquer avec le nommé ....

VO (visiting order) - but very different to Asker's context

It is my understanding that in the UK a prisoner always has the right to receive a visit from his/her legal advisor, so no permit issued by the court would be necessary.

https://www.inbrief.co.uk/prison-law/prison-visits/
"Types of prison visits
There are two types of prison visits:

Social visits from friends and family members of the prisoner
+Official visits from legal advisors and other professionals
Official visits are not counted as part of a prisoner’s entitlement to social visits. These are additional visits allowed by prisoners on top of their entitlement.

The person seeking to visit must first receive a visiting order ‘VO’ which is completed by the prisoner and sent to them. This will state the name and address of those visiting, and a unique reference number to be used when booking the prison visit. (...)"

It is unlikely, therefore, that there is any equivalent "term in UK English" as requested by Asker, and a literal translation of the French will suffice.
