Source text - English In April 2014, Justice KS Radhakrishnan declared transgender to be the 'third gender' in Indian law, in a case brought by the National Legal Services Authority (Nalsa) against Union of India and others. The ruling said:
Seldom, our society realises or cares to realise the trauma, agony and pain which the members of Transgender community undergo, nor appreciates the innate feelings of the members of the Transgender community, especially of those whose mind and body disown their biological sex. Our society often ridicules and abuses the Transgender community and in public places like railway stations, bus stands, schools, workplaces, malls, theatres, hospitals, they are sidelined and treated as untouchables, forgetting the fact that the moral failure lies in the society's unwillingness to contain or embrace different gender identities and expressions, a mindset which we have to change.
Justice Radhakrishnan said that transgender people should be treated consistently with other minorities under the law, enabling them to access jobs, healthcare and education. He framed the issue as one of human rights, saying that, "These TGs, even though insignificant in numbers, are still human beings and therefore they have every right to enjoy their human rights[.]”
Translation - Italian Nell’aprile del 2014, in conclusione di un procedimento che ha visto la National Legal Services Authority (Nalsa) contro la Union of India e altri, il giudice KS Radhakrishnan ha emesso una sentenza secondo cui la legge indiana riconosce come “terzo sesso” quello transgender. La sentenza dice:
È raro che la nostra società abbia la capacità o il desiderio di comprendere i traumi, la sofferenza e il dolore che i membri della comunità transgender sono costretti a subire; né tantomeno essa mostra di capire i sentimenti delle persone transgender, in particolare quelli di coloro la cui mente e il cui corpo non sono in sintonia con i loro caratteri sessuali. La nostra società spesso ridicolizza e maltratta gli individui transgender: in luoghi pubblici come le stazioni ferroviarie, le fermate degli autobus, le scuole, i luoghi di lavoro, i centri commerciali, i cinema e gli ospedali, costoro sono messi in disparte e trattati come intoccabili. Così facendo, la società dimentica come il rifiuto di integrare o abbracciare identità ed espressioni di genere diverse dalle nostre sia un fallimento morale. Questo modo di pensare va cambiato.
Il giudice Radhakrishan ha dichiarato che i transgender dovrebbero essere considerati dalla legge al pari delle altre minoranze, in modo da consentire loro l’accesso alle professioni, alla salute pubblica e
