Hi Everyone

I am translating a legal contract for tomorrow morning and I have some doubts about the phrase " los precios estipulados sufrirán en incremento que como mínimo experimente el IPC". It is part of a service contract and the section is discussing what happens in the event of a tacit renewal at the end of the first year. It seems that prices will increase by inflation (IPC) but I am confused about the "como minimo" part. It seems to make no sense using a "as a minimum" phrase when the next part of the paragraph stipules the exact inflation figures to use. Am I missing something or is it just badly written?

The full paragraph is:

Si alguna de las partes deseara rescindir el contrato, deberá comunicarlo, por escrito, a la otra, con tres meses de antelación a la fecha del vencimiento. En caso contrario se prorrogará tácitamente por periodos anuales. En caso de producirse estas prórrogas, los precios estipulados sufrirán en incremento que como mínimo experimente el IPC, que publique el Instituto Nacional de Estadística u Organismo que lo sustituya, aplicándose el último de los IPC conocido y publicado en el momento de la tácita reconducción.

Hi, Penelope I agree with you that the "as a minimum" part can cause a bit of confusion. As I understand it, if the agreed annual price increase is, say, 5 percent but the published IPC is below that rate, the stipulated rate applies. However, if the IPC is 6 percent, it is this inflation rate that should apply, not the stipulated rate. There is no need to use the phrase "as a minimum."

I don't find this that odd! It allows them to put the prices up as much as they want and that will be at least the current rate of inflation. Since the IPC is an official figure published by the National Statistic Institute in Spain (www.ine.es), the term will have to be included and explained.
