"Bilan économique et social et établissement du plan Le débiteur peut être titulaire de ressources ou d'un actif de nature à convaincre le juge de l'exécution de l'inopportunité de la liquidation judiciaire. Il en est ainsi lorsque le bilan économique et social établi par le mandataire révèle une capacité de remboursement suffisante ou dans l'hypothèse où une telle capacité est apparue compte tenu du retour du débiteur à meilleure fortune, comme par exemple le fait de trouver un emploi. En ces cas et à titre exceptionnel, le magistrat établit un plan de redressement comportant les mesures envisagées à l'article L. 331-7 du code de la consommation, à savoir un report ou un rééchelonnement des paiements des dettes, une remise des dettes, une réduction ou une suppression du taux d'intérêt, une consolidation, une création ou une substitution de garantie ( C. consom., art. L. 332-10)."

Wondering if there's a neat and tidy phrase for this in English.

clawback provision

The asker has asked if there is a 'neat and tidy phrase for this', and there is. It is "clawback" ins US usage and is a concept. The concept may be contained in a clawback clause, but not necessarily.

The passage would require rewording, but clawback is exactly the concept the asker is thinking of.

This of course, concerns the financial recovery of the party involved, but that is not the "neat and tidy phrase the asker has requested. That phrase and concept is exactly 'clawback', a term that will be immediately and fully understood but those familiar with such matters.

It might be mentioned that "clawback" would rarely be used in a clause, because ipso facto, it refers to future events after a fact.

Who said any thing about 'clause'. i have read and reread the context, and clawback is exactly the term that is sought. In the light of future positive devlopments, consideration may be adjusted.

for example, by his having found a job. And because this has happened, it is evident that he has regained some ability to repay.

Forget "clawback". That is (one of) the conventional translations of 'clause de retour à meilleure fortune' (another is "better fortunes clause"), but the expression is very much from the viewpoint of creditors who stand to claw back. Here you need a straightforward description of what would happen on the debtor's side to trigger a clawback.
