Spanish term

analogía

Non-PRO Spanish to English Law/Patents Law (general)
“…Los supuestos de hecho relacionados con los ordenamientos jurídicos extranjeros se regularán, por las normas de Derecho Internacional Público sobre la materia, en particular, las establecidas en los tratados internacionales vigentes en Venezuela; en su defecto, se aplicarán las normas de Derecho Internacional Privado venezolano; a falta de ellas, se utilizará la **analogía** y, finalmente, se regirán por los principios de Derecho Internacional Privado generalmente aceptados.

Votes to reclassify question as PRO/non-PRO:

Non-PRO (3): philgoddard, Rosa Paredes, Yvonne Gallagher

When entering new questions, KudoZ askers are given an opportunity* to classify the difficulty of their questions as 'easy' or 'pro'. If you feel a question marked 'easy' should actually be marked 'pro', and if you have earned more than 20 KudoZ points, you can click the "Vote PRO" button to recommend that change.

How to tell the difference between "easy" and "pro" questions:

An easy question is one that any bilingual person would be able to answer correctly. (Or in the case of monolingual questions, an easy question is one that any native speaker of the language would be able to answer correctly.)

A pro question is anything else... in other words, any question that requires knowledge or skills that are specialized (even slightly).

Another way to think of the difficulty levels is this: an easy question is one that deals with everyday conversation. A pro question is anything else.

When deciding between easy and pro, err on the side of pro. Most questions will be pro.

* Note: non-member askers are not given the option of entering 'pro' questions; the only way for their questions to be classified as 'pro' is for a ProZ.com member or members to re-classify it.

TechLawDC Aug 21, 2012:
Not analogies from case law. Analogies from legislation, the constitution, and learned commentary, as in other civil law countries. Venezuela is a civil law country.

From case law? Perhaps, but personally I would avoid the risk of this being not the intended meaning. "Analogies" seems to be a catch-all phrase - also your quoted piece from Wiki seems to be the reverse - i.e. coomon law systems using analogies, whereas I assume your piece for translation relates to a code law jurisdiction. Code law jurisdictions tend to be hostile to precedent save in very restricted circumstances.
Richard Hill (asker) Aug 21, 2012:
Analogies from case law? Analogies from precedent case law
By contrast, in common law systems, where precedent cases are the primary source of law, analogies to codes and statutes are rare (since those are not seen as a coherent system, but as incursions into the common law). Analogies are thus usually drawn from precedent cases: The judge finds that the facts of another case are similar to the one at hand to an extent that the analogous application of the rule established in the previous case is justified. http://en.wikipedia.org/wiki/Analogy#Law
