French term

l'Actif participatif

French to English Bus/Financial Finance (general)
I'm translating a text from Luxembourg about the EU Savings Directive and the Rubik agreements. There are a few banking terms that I'm not familiar with, one being l'Actif participatif.

Full sentence:
Cette dichotomie apparaît avec force dans l’hypothèse où nonobstant l’accroissement de la valeur de l’Actif participatif la société affiche un bénéfice négatif.

My translation:
This dichotomy appears strongly assuming, despite the increase in value of the equity assets , the company records negative earnings.

Any help would be greatly appreciated!

Thank you for your advice!
rkillings Jan 11, 2013:
You already understand it … … but the way you are proposing to word it won't do. You can't be talking about 'equity assets' and 'the company' in the same breath without great risk of confusion.

Savings held in the form of equity in a company, i.e., in 'participating' form, have asset value *to the investors who hold them*. From the standpoint of *the company*, that equity is on the other side of the balance sheet from its assets!

Asker I'm not sure what the phrase itself means, but for "cette dichotomie apparaît avec force dans l’hypothèse où," I suggest "this dichotomy is particularly apparent if."

Participating assets

This would be my understanding of this term. 'l'Actif' is often used to mean a company's assets and I can't think that 'participatif' could mean anything else in this context but 'participating'.
Sometimes 'participatif' can mean 'non-voting', but this is usually used in the sense of 'titre participatif' (http://fr.wikipedia.org/wiki/Titre_participatif) for non-voting securities, but I don't think this would be the meaning of 'participatif' in this sense.

Who said Person, it is a legal entity. OK!
disagree Cetacea : There is no such thing. Besides, this is not about a person or an entity.
