Długo by o tym opowiadać.... Każdy, kto ma do czynienia np. z kwestionariuszami jakości życia osób przewlekle chorych wie, że te chronione prawem autorskim koszmary są nie do ruszenia, choćby straszyły po nocach.
Z tej perspektywy, "executive" wydaje się bardzo wybaczalny

Frank, I'm not saying the word "executive" makes a lot of sense. But the fact is, as you see from the links, that it has been used, for better or worse, in a variety of Internet sources, many of them quite official. Does it mean an absolute prohibition against creating a different translation? Of course not - it's just like a judge going against previous court decisions in the common law system. However, in both cases, the threshold is higher when something is already out there, and unless it is just horrible, the tendency is to accept it.

There is the perennial struggle to translate not only words but also concepts to a foreign audience. Would a British or an American lawyer relate to "executive" in relation to the penal code? The word carries different connotations in English.

Interestingly, when I tried to google executive penal code, the only source I found was that on proz. The ones that appear in the link provided by Colleague Poplawski are Polish sources. I do not see such a concept in Western sources. For an executive code there would have to be a non-executive code, I surmise. My link lists a number of penal codes -
