I am having trouble with this expression. Spanish to English. I have included the original Spanish sentence for context and my attempt at a translation. Any suggestions?
a) En el caso de incumplimiento en el pago de cualquier suma que pueda ser debida del Franquiciador a FDS, el Franquiciador deberá pagar a FDS además de la suma un interés del 12% de la misma (doce por ciento) anual, calculada sobre una base diaria sobre el importe de las cantidades debidas y no pagadas, así como después y antes de la sentencia.
a.) In the event that the Franchiser fails to pay any sum owed to FDS, the Franchisor shall pay FDS the sum and 12% (twelve percent) annual interest on the sum. The interest will be calculated on a daily basis on the total of the amounts owed and not paid, both before and after the judgement.
Alternative: The sum will be calculated daily based on the total....

: Hi Seth. You have to be careful with the use of compounding. It's possible the author intended to say that, but the text just doesn't bear that out. Saludos.

I am afraid this is where we'll agree to disagree. Each time interest is charged, it is "compounded" (whether daily, monthly, etc.). Otherwise, all finance professionals and professors would be wrong in their teaching of how interest is determined

: You calculate OVER a period, not OVER a source of data in English.

The same in either Castilian or Spanish. If you get trouble by translating something which has not properly being created, then don´t let them blame you, either let them know about the grammar mistakes from source text, or then just translate as is (SIC).

"que pueda ser debida a"??....which may be owed...
"sobre una base diaria"??...on a daily basis..
The words are Spanish, though.....

My reading is that the interest is to be calculated each day based on the amounts owed that day. I would therefore infer that if those amounts owed change from day to day, the amount of interest charged on the respective day will also change.
