Dallas in general, and South Dallas/Fair Park in particular, suffers from a tremendous amount of property where the owner has died, but no one is probating the estate (often because there is no equity in the estate, the property has informally been handed off to someone else in the family, there are no heirs, or the heirs are unaware of the situation). This ***clouded title*** prevents the property from being transferred on the open market and also may prohibit the residents living in the home from applying to much-needed assistance programs.

Chain of Title/Clear Title/Clouded Title - When the ownership of a property is researched (searched), the person who does so reviews the many transactions of transferred interests from one person to another. This chain of title identifies the history of how the ownership changed from the first owner to the current parties of interest. If the chain shows no missing links and no liens or other conditions to the title, the current owner is considered to have clear title. If there are questions of any kind as to the validity of the ownership, the title is considered clouded.

Bishop Bruno very unfortunately apparently had the legal power to sell the property himself as “Corporation Sole” — there was no committee oversight. The property had “clouded title,” however, because of a title stipulation that the 1940’s-donated property had to be used for religious purposes...

Encumbered Title

If there is some sort of lien, levy or other legal complication or claim to the title it is no longer a "clear title" meaning full ownership rights and responsibilities. Rather there is some legal issue with it, and it is said to be "encumbered."

Parece que las definiciones de "encumberance" suelen variar un poco, según la famosa wikipedia se trata de "a right to, interest in, or legal liability on real property that does not prohibit passing title to the property but that diminishes its value," o sea algún interés económico en la propiedad por parte de un tercero. "Clouded" tal vez sea mejor si el tema del título no tiene que ver con tal tipo de demanda económica.

imperfect title

La evaluación de expertos de distintas áreas hace foco en el condicionamiento de cada figura sobre el título, con los costos en un plano secundario. Ya que un título "imperfecto" puede tener, coinciden, una incidencia más perniciosa que el valor de un trámite.

Leonardo Glikin, director de CAPS Consultores, dice que "ante el cambio de condiciones, la donación no es una alternativa conveniente" para quienes se ocupan de prever qué pasará con los bienes después de su fallecimiento. Antes, explica, la donación transfería un título no observable, es decir, que ningún tercero -por ejemplo, un hijo extramatrimonial- podía reclamar parte de una herencia. "Pero ahora, que alguien puede ser designado heredero tras un fallecimiento, el título proveniente de una donación se considera imperfecto, hasta que hayan pasado diez años", contrasta.

What is an Imperfect Title?
In a real estate context, an “imperfect title” refers to title that is defective and does not convey full legal transfer of a parcel of land or real estate.  A title can be imperfect because:
• It contains an “encumbrance”, such as a property lien or easement
• There are unresolved disputes as to the actual ownership of the property
• There have been errors or issues regarding the recording of the title
• The title has defects with regards to property descriptions
• Any other inconsistencies that might cause the ownership of the land to come under question
Thus, an imperfect title cannot really be used to convey property from one owner to another.  Before property can be transferred, the title needs to be “marketable”, meaning it should be free from any of the defects listed above.

Title requiring further exercise of granting power to pass the fee in land is imperfect title. An imperfect title does not convey full and absolute dominion.
