YYY does not accept that the paragraph is ***subject to without prejudice privilege*** but because it is not necessary to refer to the paragraph in order to make this application, YYY has redacted the paragraph so as to avoid any debate about the point.
Significa simplemente "información privilegiada" o ¿qué significa exactamente y cómo se diría en español (que no suene a una traducción literal sin sentido)?

Como normalmente "información priviligiada" en español solo se refiere al ámbito de la información financiera (que podrían afectar la cotización de acciones, etc), no estoy segura de utilizar "información privilegiada" sino hacer una explicación más extendida como "el contenido de ese párrafo constituye información privilegiada que no puede divulgarse ni presentarse como prueba en un juicio, salvo previo acuerdo entre las partes" o algo así.
