English term

equity

English to Polish Law/Patents Law (general) upadłość
Bardzo proszę o wyjaśnienie. W piśmie z brytyjskiego Insolvency Service pojawia się termin "equity" w takim kontekście:
"Please confirm whether or not the property was repossessed and whether it has been sold. If so, could you please confirm if EQUITY was made from the sale after all costs."

"Any equity should be held to the order of the trustee".

Z góry dziękuję za wszelkie wskazówki.

31.3.117 Equity in the property and the insolvent’

The difference between the value of the property (see paragraph 31.3.97) and the amount outstanding under the secured loans (see paragraph 31.3.112) is known as the equity. Any beneficial interest in the property will be an interest in the equity of the property (see paragraph 31.3.14). The level of an insolvent’s beneficial interest in the property can be affected by a number of factors, i.e.:

Equity of exoneration (see paragraphs 31.3.118)
Setting aside of charges (see paragraph 31.3.124)
Intended or effective division of shares (see paragraphs 31.3.129 to 31.3.146)
Equitable accounting) (see paragraphs 31.3.147 to 31.3.152)

If you own your home it can be sold if it is the only way to pay your creditors.

Sole owners
If you’re the only owner of the property:

the value of the property after any secured debts (eg, a mortgage) have been paid transfers to the trustee. This is known as the ‘beneficial interest’ and is sometimes called equity
the legal title transfers to the trustee and a bankruptcy restriction is added to the land registry record. This will stop you from selling your home or making deals connected to it
The restriction will be removed once the trustee has been paid for their interest in the property.

Equity in the property (e.g., a house) is that part of the value of the house after all the mortgage loans have been paid off. Here, there are also fees asssociated with the sale of the house (penalties, realtor's commissions, etc.) to deduct.

Equity also refers to the difference between an asset's current market value -- the amount it could be sold for -- and any debt or claim against it. For example, if you own a home currently valued at $300,000 but still owe $200,000 on your mortgage, your equity in the home is $100,000.

masa upadłościowa

może w kontekście Insolvency Act o to chodzi?
