Italian term

rinuncia tolleranza inadempimento

Italian to English Other Law (general) corrispettivo inglese di una formula contrattuale

Ipotesi:

A waiver by us of any default will not constitute a waiver of any subsequent default.

An acceptance, if any, of lack of fulfilment by you, will not be deemed a waiver of any subsequent breach.

The waiver by us of any breach shall not be construed as a waiver of any subsequent breach.

Discussion

Francesca Brandi (asker) Sep 18, 2018:
Sorry Philgoddard to answering you so late, it was not a heading.
James (Jim) Davis Aug 30, 2018:
breach of contract Isn't breach of contract, violazione di contratto, oppure violazione delle obligazioni contrattuali?
Josephine Cassar Aug 29, 2018:
@philgoddard But how can you waive enforcement of a breach? It is like saying that you are in favour of the breach. 'Waive a breach' gets a lot of google hits. E.g.: https://contracts.uslegal.com/breach-and-remedies/. Tolerate a breach is ok though it is not the technical word.
philgoddard Aug 29, 2018:
Francesca/Josephine/Antonio You can't waive a breach, though you can waive enforcement of it. Tolerate is better.
Also, the three-word question is not a full sentence, which implies that it's a heading. Could you confirm that, Francesca?
Francesca Brandi (asker) Aug 29, 2018:
@ Francesca Non ho messo tolerance, your part e if any xke nn c erano nella domanda .. .
Francesca Brandi (asker) Aug 29, 2018:
Forse la migliore: Our tolerance, if any, of a breach of contract on your part, does not constitute a waiver of any subsequent breach.

does not constitute a waiver of our right to respond to any subsequent breach

Quindi la frasa intera sarebbe:
A one-time exemption from us in response to a breach on your part does not constitute a waiver of our right to respond to any subsequent breaches.

The waiver by us of any breach shall not constitute a waiver of any subsequent breach

any possible waiver, by us, of any breach on your part, shall not constitute a waiver of any

of any subsequent breach. It is a waiver, not acceptance as the idea is 'surrender' of a right not just acceptance. https://www.contractstandards.com/public/clauses/waiver

failure ... to take action ... waiver of our right ... failure to perform

This is a specific breach that of failure to perform inadempimento

"Any failure on our part to take action on failure to perform on your part does not constitute any waiver of our right to take action on any subsequent failure to perform"
I think the moderator should have banned this because in reality it is not a term nor even three terms, but a whole long sentence.
