French term

bases de liquidation

French to English Law/Patents Law: Taxation & Customs
Legal note on the interest in bringing an appeal against a judgment of an administrative court.

From the context this expression appears to mean "reasons for liquidation". But why use bases if so? There are lots of hits out there for this expression, so French lawyers like it. I'd prefer not to guess that it is what I assume it is (if someone knows better).

Discussion

Eliza Hall Oct 30, 2020:
What Suzie and AllegroTrans said Suzie's right about the meaning and AllegroTrans has proposed a good translation. The EN word liquidation is a faux ami for this term. See the legal and financial definitions of FR "liquidation" here: https://www.cnrtl.fr/definition/liquidation
Suzie Withers Oct 28, 2020:
Having looked at a few references, it seems to mean "details of what the debt is for", but I have no idea how that would be expressed in nice, legal English! It seems to be a standard term used in relation to public finances.

bases /'pillars' of itemised assessment > of a liquidated demand

Liquidation in other Romance languages can also often simply mean a calculation - a ProZ SPA>ENG favo/u/rite - an assessment, say of tax, or the taking of accounts.

Liquidated demand in English law, as in liquidated damages, is now a fixed-sum claim.

titre exécutoire often bolis down to a judg/e/ment debt

PS I had also hit on Susie W's web ref. that seems to imply schedules of itemis/zation annexed to the proof of debt.

Example sentence:

Four Pillars of Assessment: Purpose · The importance of purpose · Three steps for robust assessment ·

If a debtor requests information about an amount claimed as owing, or how that amount has been calculated, you should provide the debtor with an itemised statement of the account clearly specifying: the amount of the debt and how it is calculated.
