As to paragraph 3, the first sentence is admitted. The second sentence is embarrassing for want of particularity. The Claimant does not identify any material facts in support of the bare assertion to support the allegation that Mr Jimenez was acting in his personal capacity or as agent for Mr Cash. In any event, the balance of paragraph 3 is denied. In relation to the making of the Loan to the Club, Mr Jimenez was acting on behalf of the Club. Mr Jimenez reserves the right to plead to paragraph 3 in the event that the Claimant sets out his case in respect thereof.
