Surely, la documental is short for prueba documental.
I like the idea of incorporating secret-trust and warning-sign etc. documents by reference to a Will or Contract, but am unsure that such applies here.
Petitioning the court to consider documents exhibits in the case might, if necessary, be done by motion or application in Anglo-Am. jurisidictions.

It depends. The documents could have been referred to in some distant portion of the deed, the "above" means in the above paragraph or two., maybe?
