We need context. It could be that the mentioned official is the person responsible for determining (deciding, adjudicating) the case because it falls within a certain category of cases (those which are brought under Art. 84) that the law specifies will be decided by the person holding a given title. But that is just speculation. We need more context.

It may be "The... determined", but I agree that we need the previous sentence. Once we know that, it's a non-pro question in my opinion. There are several possible synonyms, but "determine" seems the obvious choice.

My take Although it obviously means "determining", I don't think we can blithely begin the translated sentence with "Determining…", at least not without seeing the previous sentence/s. As it stands, I think I would try to paraphrase it.

In the law the term whereas also is used as the introductory word to a recital in a formal document. A recital contains words of introduction to a contract, statute, proclamation, or other writing. In a contract a whereas clause is an introductory statement that means "considering that" or "that being the case."
