The Options are Option Agreements on plots of lands (the Plots), this is taken from a contract of sale:
"All the Options relating to the Plots are existent (not putative), valid, effective and fully enforceable (including, in case the Owners fail or refuse to execute the purchase agreement, the enforceability before the competent court - pursuant to section 2932 of the Italian civil code - of the Owner's obligation to conclude the purchase agreement in order to obtain a jurisdictional decision having the same effects of such purchase agreement) and will not expire earlier than 31 December 2016, with the exception of the Option for the Plot E and Plot F which will not expire earlier than 15 February 2017 (i.e. at least by this date the Subsidiary may cali any and all owners of the Plots to sell the relevant Plot and acquire the ownership title to any and all Plots)."

Vedi mio post in discussione. Considerando il semplice significato della parola "putativo" credo che una traduzione letterale in questo caso vada più che bene. In altre parole sta dicendo che si tratta di contratti la cui esistenza è effettiva, non presunta. Potresti tradurre "are existent (not putative)" con "(sono) effettivamente esistenti, non putativi".

All'art. 8 mi sembra che si parli di contratti invalidi in quanto affetti da una sorta di vizio del consenso (ora purtroppo non riesco ad approfondire), come se la loro esistenza fosse presunta ma non reale in base ai requisiti stabiliti dalla legge per la stipula di un contratto (es. l'incontro delle volontà ecc.). In ogni caso si trovano pochissime occorrenze di "putative contract"; questo testo https://books.google.it/books?id=W5j15nhzPFQC&pg=PA53&lpg=PA... parla di "contratto putativo" facendo riferimento proprio alla situazione di cui sopra.
