I agree that some insurers will only provided extended coverage for the same fundamental representations under a seller indemnity.
But that is not the same thing as a closing condition bring down standard (which even in a seller indemnity deal might apply to a different set of reps than those indemnified as fundamental). As a practical matter, it is completely market for a R&W policy to include the benefits plan rep in extended coverage, and it is similarly completely market for the benefits plan rep not to be brought down to the higher standard.
