I think both the answers accurately explain the sense of 'traslación' in the field of prosecution. which implies the reclassification or the redefinition in a description of the offense or the problem. It's quite clear that no prosecution action has taken effect yet, though in the current investigation, the Public Ministry intends to do appropriately, in accordance with the penal code.

Presumably it's "acción penal": when they decide what the offence is (tipo) they'll press criminal charges (at least, that's how I understand it)
