What we do

We’re responsible for handling appeals against local authority decisions regarding special educational needs, including a refusal to:

assess a child or young person’s educational, health and care (EHC) needs
reassess their EHC needs
issue an EHC plan
change what’s in a child or young person’s EHC plan
maintain the EHC plan

We also handle appeals against decisions to refuse young people in custody:

an EHC assessment
an EHC plan after assessment
a placement to a suitable school or other educational institution after their release

We also handle appeals against discrimination by schools or local authorities due to a child’s disability.

What is the SEND Tribunal?

The First-tier Tribunal (Special Educational Needs and Disability) (the “SEND Tribunal”) is an independent national tribunal which hears parents’ and young people’s appeals against LA decisions about the special educational needs of children and young people. It also hears claims of disability discrimination against schools.

You can appeal to the SEND Tribunal if you’re unhappy with a decision made in relation to an EHC needs assessment or an EHC plan. There are no fees for parents or young people to pay. The SEND Tribunal has the power to order LAs to carry out EHC needs assessments, issue EHC plans, and amend existing EHC plans. LAs must comply with orders made by the SEND Tribunal.

The tribunal will not consent to any withdrawals or conceded appeals within 5 working days of the final hearing date. An application for concession or withdrawal made within five working days of the final hearing will be REFUSED and the parties will be directed to attend a hearing before a Tribunal Judge to explain the reasons for the late settlement of the appeal. The hearing may be on the same date as was fixed for the final hearing or within 5 days of it and the parties will be notified of the date when they contact the Tribunal.

Wygląda na to z tego co znalazłem w internecie, że conceded appeal to sytuacja, w której druga strona uznaje apelację. W polskim prawie funkcjonuje termin uznanie powództwa. Czy on będzie odpowiedni w tym kontekście - może mając na względzie specyfikę anglosaskiego systemu prawnego wskazać, na uznanie apelacji.
