Is there a specific term in English law for "unvertretbare Sachen"? Custom-made, tailor-made, customised all work for Einzelanfertigung. I can only find unjustifiable goods in translations of German AGB. Would "bespoke" work? The term is a German legal term - is there an equivalent term in UK law?

What is meant by fungible things?
Fungible things are items that can be easily replaced with another item that is practically the same, such as wood or paper currency. Often, whether or not an item is fungible will impact how damages will be calculated for breaches of contract or the destruction of an item.

agree Susan Starling : This involves BGB Kaufrecht so that should be the first place to look (rather than other AGB translations). The (unofficial) EN translation of "vertretebare Sache" as per Sec. 91 BGB is "fungible things", so yes, "non-fungible items" seems reasonable.
