Denyce is correct and the phrase should be "an award of costs", i.e., “Any award of the arbitrators may include {an award of costs}, including reasonable legal fees and disbursements.”

对双方费用的建议

严格来说,“仲裁”是司法体系以外的解决纷争方式,仲裁的结果,是{recommendation}而不是{judgement},亦没有法律地位,不能执行,完全只视乎双方对仲裁结果的态度,所以不应该被翻译为“裁定”。

就是因为不能执行,所以需要向法院申请,所以在法律上,不能算作“裁定”,也不可以算作“裁决”。

neutral Helen Li : 如果双方选择仲裁作为争议解决方式,符合法律规定的仲裁裁定是具有法律效力的。如果一方不执行,对方可以向法院申请强制执行仲裁裁决。例如,可参照《中华人民共和国仲裁法》第六十二条规定:“当事人应当履行裁决。一方当事人不履行的,另一方当事人可以依照民事诉讼法的有关规定向人民法院申请执行。受申请的人民法院应当执行。”

理论上的和实质上是有很大的落差的,第六十二条所写的,整体上跟外国的都是一样,都是“.....应当....应当.....应当.....”。所以在开庭的时候,还是需要把案件从新审理,把双方所有理椐,从新辩证,从新举证,所以结果不一定需要跟仲裁结果一样。难处就在这里。如果胜方是对法院的审理是有信心的,当初也不用通过仲裁。这也是仲裁结果只是一个{recommendation}而不是{Judgement}的原因。
