Wouldn't "This subject has an active custody" mean that "this subject" has something/someone in his/her custody???
If it was about the prison system having custody of this prisoner, wouldn't that be:
"This subject is in (active) custody"???

Yes, this is referring to the prisoner, not to an active custody of a child.
