In this case before the Employment Tribunal, we hear about a "procédure collective" (insolvency proceedings) in which the lawyer in charge has "diligenté une action en comblement de passif à rencontre de la Société XYZ".

I'm wary of suggesting established UK insolvency terms that are usually disliked by translators.

Anyway see the UK Insolvency Act 1986 for cases of personal liability to contribute to the co's assets i.e. to make up for (comblement) the shortfall:

s. 212 - misapplication of funds coming to light on a winding-up
s. 213 - fraudulent trading - court can order any party to make a contrib.
s. 214 - wrongful trading - court can order an ord. or shadow director to make a contrib.

The last 2 apply to an insolvent liquidation of a company.
