Dutch term

wanbedrijf - misdrijf

Dutch to English Law/Patents Law (general)
Is it so that wanbedrijf is a "misdemeanour" while misdrijf is a "criminal offence".
Het misdrijf opgesomd in art. 15 is een wanbedrijf.

Thanks,
Zeljko

misdemeano(u)r - (criminal) offense / act

It is a bit risky when it comes to choosing a proper translation, because it involves comparison between two quite different legal systems. Anglosaxon Common Law differentiates among felony (seriosu crime, more than 1 yr in prison), misdemeanour (less serious, less than one year) and infraction (no prison, money punishment...) - Ref 2. I compared this to the definition from Wikipedia (Ref 1. below) and concluded that "misdemeanour" is more or les equivalent to "wanbedrijf".

Misdrijf is used in your phrase as a generic term for all criminal acts.

(I used US spelling).

Sve najbolje.

offence - felony

Van Dale:
wanbedrijf het ( in België; juridisch )
crime
offence
context
straf voor wanbedrijven
punishment of crime(s) / offences

Don;t know whether that makes it a misdomeanor

Van Dale and JURLEX
misdrijf het
criminal offence / act
crime
( juridisch ) indictable offence, felony
context
de politie denkt niet aan een misdrijf
the police do not suspect any foul play
een ernstig misdrijf
a serious crime / offence
een misdrijf plegen
commit a criminal offence
etc.

The Van Dale EN-NL goves:

'mis·de'mean·our, 'mis·de'mean·or
( telbaar zelfstandig naamwoord )
( juridisch )
misdrijf ( minder ernstig dan misdaad, maar zwaarder dan overtreding )

so it conflicts with the NL-EN
