Notaries (notariusze)

Notariusze to trzeci i zarazem najstarszy zawód prawniczy w Anglii i Walii. Jego początki sięgają panowania rzymskiego w Zjednoczonym Królestwie. Notariusze mogą prowadzić praktykę zawodową, a uprawnienia do prowadzenia praktyki nadaje im specjalny Faculty Office (urząd przy kurii arcybiskupiej). Po raz pierwszy dokonał tego arcybiskup Canterbury w 1279 r. Organem regulacyjnym tego zawodu jest Court of Faculties (Sąd Arcybiskupi). Działalność notariusza tworzy pomost pomiędzy prawem cywilnym i common law.

The admission and regulation of Notaries Public in England & Wales is one of the functions of the Faculty Office. The Master of the Faculties (the judge who presides over the Faculty Office) is the approved regulator of the profession. This jurisdiction regarding the Notarial Profession was confirmed and enhanced by the Courts and Legal Services Act of 1990 and the Legal Services Act 2007. Both confirmed the Master’s statutory powers to make Rules for the regulation of the profession.

Although The Faculty Office of the Archbishop of Canterbury regulates Notaries (and the ‘faculty’ appointing a Notary is issued in the name of the Archbishop), a Notary is a secular lawyer and is not otherwise associated with the Archbishop or the Church of England.

The Faculty Office of the Archbishop of Canterbury also maintains jurisdiction for the appointment (and partial regulation) of Notaries in certain overseas jurisdictions. See the link below for further information.

The Master of the Faculties is a functionary in the office of the Archbishop of Canterbury and has some important powers in English law, in particular the appointment and regulation of public notaries. The position is always held by the Dean of Arches.

Stanowisko notariusza dostępne jest dla absolwentów wszystkich kierunków studiów, nie tylko prawnych. Każdy przyszły notariusz musi uzyskać dyplom praktyki notarialnej (Diploma in Notarial Practice). Zgodnie z ustawą o sądach i usługach prawnych z 1990 r. prawo do określania wymaganych kwalifikacji przysługuje przewodniczącemu Faculty Office (Master of Faculties)
