“Hearing binder” es el archivador (o carpeta) que contiene el material o la documentación que presentan las partes en los procedimientos, en concreto en la “audiencia probatoria“ o de presentación de pruebas, en inglés “evidentiary hearing”. En Estados Unidos hay juzgados que son muy rigurosos respecto a los requisitos formales de presentación de pruebas, ya que el orden de la documentación facilita el trabajo del juzgado y del juez. Hay juzgados que incluso tienen “hearing binder guides” para orientar al respecto a los intervinientes en los procedimientos (véase enlace inferior).

g. Hearing binders shall contain only the substantive documents necessary for the hearing (e.g., motions and responses going forward). Do not include in the binder certificates of service or the service lists filed with each pleading unless an issue has been raised about sufficiency of service, in which case only the appropriate portion of the service list shall be included.
