Spanish term

en su tercero o por suerte

Discussion

AllegroTrans Oct 20, 2021:
Record needs to be set straight There were two "disagrees" (one of them mine) to Oliver's answer and a moderator has removed them on the basis they were personal rather than linguistic comments. This is not strictly true, as both comments essentially questioned the logic of leaving a dispute to chance. That suggestion is totally absurd and what this text says, albeit in shorthand, is that where two abitrators don't agree on a third arbitrator, they draw lots to choose that arbitrator. That does not equate to leaving the dispute "to chance".

with /a third arbitrator made/ umpire or one nominated by drawing lots

Below is a link that ought to work...

'..podría referirse a un tercer árbitro?' Yes, I think so.

The second link seems to imply that the arbitration decision can be reached by 'drawing lots', so I'm sticking to the ProZ French answer of the arbitrator being chosen by such method.

> en arbitrios de derecho *y/o* de equidad : artibtration hearings held in strict accordance with the law *and/or* ex aequo et bono rather than equity with a small 'e' meaning fairness vs. Equity in English law with a caital 'E' as a distinct body of law.

tercero dirimente - umpire + en discordia - umpire, West explaining both: 'an impartial third arbitrator who decides when the other arbitartors have been unable to agree'.

Indeed, suerte as a variation on sorteo.
Example sentence:

the two arbitrators fail to agree upon the appointment of an umpire, each of them shall nominate three individuals to serve as umpire, of whom the other shall decline two and the umpire shall be chosen from the remaining two by drawing lots.
